Question

I have been at the AMA hearing with VLJ level of the BVA since November of 2019. I spoke with a representative at the BVA today and was informed that in December 2020, 13 months ago, I had a hearing canceled and that it is supposed to be rescheduled. That seems odd that it has been 13 months. I never heard about this hearing or cancellation until today. 

Is this common at the BVA level or does it need to be questioned?

Yes It's a lot of funny stuff goin in with the va.

They did me a little different I never requested to be removed from legacy appeal.

I was send a letter that I had to do a nod to continue my appeal are it was remand by the court.

I did the nod you have to check the box to opt in to ama after a ssoc soc is issue on the legacy appeal.

Well I never check the box. To be removed

 

And they still remove my appeal from legacy and process it as a new 2021 appeal. Removing 3years and remove it from legacy appeal.

Like they say they are try to get rid of legacy appeal even if you choose not to go in ama system. Smh.

Some will not see the problem either with them change docket numbers.

And removing appeal from legacy appeal system.

To clear the legacy appeal system.

due respect to everyone but Covid is an excuse to slow things down. Sadly The VA is not the only organization to use this to slow things down.

From my understanding the Board is “supposed” to be working on all BVA appeal lanes, that means, legacy, RAMP and AMA. I am not sure how they are doing this but as you can see below there are some major problems. There is no real estimate of any given time frame of any decision completion date. The BVA no longer has a direct number contact and even if you try to do an inquiry it seems to still go to the call center that has absolutely no clue of what is going on at the BVA. It is just going to get worst.
