Question

So I opened a claim for OSA 2 weeks ago secondary to my vestibular disorder stating that the vertigo and balance issues make it impossible to keep and excercising routine and the weight gain I have at this point is due to the lack of excercise and the meds. I'm on for Anxiety / depression which is also service connected due to my severe hearing loss. They sent a paper saying the outsourced people will call if they need to for a physical. No calls. I checked my work in process and both were denied. I didn't even put it in for a fully developed claim yet because I have my follow up appointment with my sleep doctor this Friday. I guess they don't even let you get all your info. in before denying now. My other claims never went this way. Not sure what to do at this point. Didn't even get a chance this time. I may be wrong, but I think you are talking about two different things. 1. An IMO and 2. A C & P exam. Yes, there is a major difference. The difference is that the C & P examiner may or may not agree that your claimed disability in related to your military service or any of your service-connected disabilities. You need a separate Independent Medical Opinion that connects your claimed disability to either your military service or an already service-connected disability. Now as to the C & P exam and due to the COVID, you can try and call the 1 (800) 827-1000 number and explain that you were never contacted by an examiner and that you could not be a no show because you never had an exam to go to and they could try to help you or they may say that you have to write in a response which may include a disagreement. Call the number as soon as possible to see what they say.

Pacmanx1 , my wife and I called last night. The lady we spoke to said that the QTC firm for the C&P filled out the questionnaire on 1/21/22 and we spoke to QTC on 1/22/22 and they gave us an appointment later that day on 1/22/22 with a 3 hour window on when they would call for a phone exam. Nobody called. They then denied the claim the following week.  The lady from the 800# said the only thing I can do is appeal. This sucks because I feel the VA robbed me of step 1 in this process. Now I will need to appeal and wait even longer for anything to happen. I guess its the hampster wheel. I'm pissed that QTC filled out my info without even speaking with me. Now I'm working on getting an IMO or IME because out of my 4 different doctors i have at the VA, none of them will help out with my claim and stating what needs to be stated. I guess SNAFU.
