Carl the Engineer
What is the proper remedy for this example. 1. Veteran has malady in service, treated, recovers, 2003. 2. Veteran claims malady within 1 year after service, denied, not chronic, 2008. 3. Veteran is diagnosed with malady by the VA, given medication twice daily, chronic, 2019. In my example, the malady is GERD or esophagitits, but it could be a different malady. Your prefered course of action? Carl “There is no hook my friend. Carl Baby steps, first thing is to file a claim for GERD/ACID REFLUX/STOMACH PAIN and go from there, you know the deal if the claim is denied then file an appeal and if the claim is granted, if you have enough post service evidence, then file an appeal for a better effective date or rating percentage. Vync and Carl the Engineer 2 My intentions are to help, my advice maybe wrong, be your own advocate and know what is in your C-File and the 38 CFR that governs your disabilities and conditions. Do your own homework. No one knows the veteran’s symptoms like the veteran. Never Give Up. I do not give my consent for anyone to view my personal VA records. Usually, medications for service connected conditions will cause gerd. Carl the Engineer and Vync 2 I am not a lawyer so take my opinions with a grain of salt... If I had listened to the nay sayers, I would never have acheived any ratings after I was awarded TDIU in 1999. Now I have not one but two 100% ratings, a TDIU and 4 SMC awards !
