Since I have been waiting since August 06 on a claim for MI and PTSD I asked the Voc Rehab folks if I could go back to school, I was told no.

I was attending college with Voc Rehab prior to recall to active duty. I send a letter to the Voc Rehab and asked if I could start back up. They said no as they seem that I'm too unstable to attend classes.

What is this all about. What direction to I go now? If you reply please type REALLY SLOW as it seems my educational skills have severaly wained over the past two years.

If you are unemployed and have applied for TDIU and Voc Rehab stated that you are 'unstable' due to your PTSD or any other SC has made Vocrehab unfeasible for you-anfd they denied under that basis - this is good evidence to support a claim of TDIU- Total Disability due to Unemployability-

if one is not working and is un voc rehabable due to SC -one is unemployable-due to SC.

Actually I think some folks have got some misconceptions about vocational rehabilitation.

1. Just because you ask for the program does not mean you will get it regardless of rather you think you can work or not.

2. You must have a sc disability, before you are even considered eligable for the program.

3. Just because you have a sc disability does not mean you will be accepted into the program.

4. You can still be working when you request the program.

5. Just because you are not working does not mean you will be accepted into the program.

6. If you are retired for any reason it is likely you not be accepted into the program (program is for people able and willing to work who are not retired, tdiu, or 100%.

7. If you are not accepted into the program they will not evaluate you for job skills, so may not say if you can work or not.

8. If not accepted then you may ask for independant living services, which can also be denided.

I used a Voc Rehab evaluation like yours to help me get IU. If you can't go to school how can you work?

Rckb54 is correct! One has to remember when applying for VocRehab, the veteran must show that their service-connected disability somehow has or is interfering with their means to earn a living. Then they must be able to have some sort of academic plan in place, meaning some type of training that they would like to do which would help them earn a living and not have their service-connected disability interfer with that training and later a career in that field.

You might get a private vocational rehab specialist to do a evaluation of you. This way there is no risk that they will find you able to work or be rehabilitated. You are paying for the evaluation and you get what you pay for usually.

Army:

In as kind a way as I can post you need to read what is posted. You are not eligible probably cause you are not Service Connected enought to get it. I have some more bad news as if you get Service Connected for PTSD most of the Voc Rehab people will turn you down.

For your plan to work you need to get Service Connected at least 20%. Than you ask for Voc Rehab and they will make an appointment and tell you in their opinion if you are eligible or not. I suspect that if you tell them up front that you want to be deemed unemployable for TDIU purposes you can bet a quick you don't qualify.

Finally if Voc Rehab says you cannot work you may be eligible for ILS or Independent Living and they will look into getting you something to help pass your time better.

You have probably passed you opportune time cause I hear that ILS is broke for 2007.

My last rant. Be selective and choose your battles carefully with the VA. I am amazed at how many have never even looked at their "C" File. And if you claim goes back a few years you almost have to have an Outside Medical Opinion to back you up.

Maybe in June you can hire a lawyer and they can help?
