Asked The Ogc For A Pres Op
A claim I filed in January 2003 has not been addressed yet by the VARO. (well they said twice I would get an administrative decision but two months ago they said it was "in appeals" and I immediately reiterated that they never gave me a decision I could appeal. It is clearly a legal question issue and no one but VA counsel can decide it. I told the VSM last month that this claim certainly should have been given to counsel long ago. "Questions Presented" in OCG pres ops are questions that arise =in most cases-within claims issues that need a legal opinion for the VARO to use to decide the claim. Sec 1151 recepients are denied many ancillary benefits- also whe…

Received New Info On A Pending Claim(mri) What Do I Do Now?
Hello all. I currently have my first claim in with the VA after exiting service via disability in Nov 05. I had all my C&P's back in January. I am still under Tricare Prime for the first six months after exiting service so I am seeing a civilian Dr. One of my claims in is for "Lower back pain with sciatic pain radiating into left leg. Well at the C&P they took an X-ray. Thats all Ive ever had. My pain has gotten worse and my civilian Dr sent me for an MRI. The Dr of radiology at the hospital said that I have the biggest herniated disc he has ever seen. The official MRI report states "EXTREMELY Large Left Herniated Nucleus Pulposus at L5-S1 with a smaller…

ptsd Prolonged Hospital Stay To Establish Ptsd Nexus?
Hello Everone! I am new here and appreciate all the good advise I see here. My Q is this: If I go into a long PTSD program - will it help establsh the nexus thing the VA always wants. I have severe PTSD but havn't to date been able to show service connection despite my Personnel moves, etc.. I desperately want the gov't to believe it. It has been horible and I can't break the grip it has on me. Will the PTSD treatment increase my odds of the gov't believe I was assaulted? Also, I'm 10% SC for migraines - will I get 100% for that while in hospital? I am just a hop & a skip away from being homeless so I am feeling somewhere between hopeless and desperate beca…

Twofold Purpose For Adequate Reasons And Bases.
This came from an Admin letter. 5. REASONS AND BASES a. All decision documents, including ratings, Hearing Officer decisions, and administrative decisions, must be written so the reader will understand the precise basis for the decision. Letters to claimants communicating denials must indicate the evidence considered and the reasons for the decision. b. In Gilbert v. Derwinski, U.S. Vet. App. No. 89-53 (Oct. 12, 1990), the Court emphasized the responsibility VA has for ensuring that the Court understands VA's decisions. The Court noted that one of the reasons given for requiring reasons and bases for a decision was "…

Part D And Va Drug Drug Benefits
I just got a letter in the mail today from the VA saying the drug coverage I get from VA is as good as that from Medicare Part D. This means we don't have to sign up for Part D any time soon and that there will be no penalty if I do.

Question For Berta, Morgan, Vicki
When I submitted my claim I included my OGTT test result and the internists DM2 diagnosis based on this result. My DM2 had not shown up on the fasting glucose test which is not an unusual thing. As I read various articles on DM2 I notice that either of these tests should be repeated on another day to confirm DM2. In your opinions, would I be better served to spend my own dime now and get another OGTT to send in as supplemental info? Might this preclude a possible delaying tactic of requiring another test to confirm diagnosis? And also preclude the likely prospect the VA would provide only the cheaper ,quicker and in my case possibly misdiagnosing fasting gluco…

Is It Normal For Eegs To Flip Flop Over The Years
When I filed my original claim back in Nov 76 for post concussion residuals due to Brain Trauma I was awarded 10% in view of no objective findings. I filed for an increase in rating in Mar 05. The TBI occurred in 1972 while in service in the Marine Corps. At that time I had a compound depressed skull fracture with left temporal lobe contusion, chronic. The Navy at GL NH performed a crainiotomy, brain debridement with boned fragments and fracture imbedded in the brain. The dura was lacerated. At that time I was given an EEG of which the results showed abnormal with a "clear focal slowing in the left temporal area" and that "this condition may improve over time." …

Morphine And Driving Privilages
Went to renew my drivers lisence a few weeks ago at the county office because the mail in form said $20.00 and in my state if you're 100% it's free, hence the county office in person. The person taking care of me started the interview and then walked away, a few minutes later she comes back with a "supervisor" who asks "how long you been in that wheelchair?, Do you have special controls in your vehichle? Can you walk at all?" I say, I've been using a wheelchair for eighteen years and never been asked these questions before, no, I do not require any special controls and yes I can walk but it's not a comfortable thing to do. She says, "please walk over to that wall and…
