Recall On Technetium
My husband had a heart stress test at the VA on Nov.15 and he received a letter from the VA yesterday that the manufacture (Mallinckrodt Corporation) had notified them Nov. 21st that the drug had been recalled. Well in Dec. he got a bad sinus infection(one of the side effects) and missed work and was on antibiotics. My question Is the VA reponsible for anything, since they didn't notify him until over 3 months later?

I would venture to say most of us who have read this have read only Part 4 Last night Icould not sleep so I sat up reading the laws. WOW I learned some stuff! Like for example under § 21.52 Serious employment handicap it states Requirement of determination of serious employment handicap. A separate determination whether a serious employment handicap exists shall be made in each case in which an employment handicap is found. Secondary Condition Or Not
Thanks to this board and the people on it I have learned that there is a real good probability that my vertigo is a secondary condition caused by my herniated disc in my cervical spine. http://www.hadit.com/forums/index.php?showtopic=2798&hl= So my question is, am I better off trying to pursue the vertigo as a secondary condition or as a seperate issue?
