Berta And Morgan
I would like to thank you for the help you provided as I "assembled" my additional claim package. It appears to be a literal work of ART, with everything except Christmas tree ornaments adorning its glittering text!!!!! There are multicolored stickums connecting references to attachments, italics, underlining and bold lettering and sometimes all THREE at once to highlight key points! There are pertinent references to specific BOVA citations relating DM11 and CAD and AFIB as well as the Framingham studies.! There are specific references to three court decisons and at least five more references to sections and subsections of 38 C.F.R ! There are highlighted…

diabetes Questions For Berta
BERTA, I am about to submit new evidence to a claim for AO/DM11 that I formally paused just as I was scheduled for some C&Ps. Based on a IMO from my cardiologist it appears I can claim service connection for significant heart problems caused/aggravated AS LIKELY OR NOT, by the DM11. I have found in the VA Code 38 schedule ratings that appear to describe and rate my heart problems almost perfectly. Also have found a couple of remands from various BVA's that appear to support my claims for the connection between AO/diabetes and my heart issues. MY QUESTIONS! In your opinion, 1. Is it "wise" to specifically point to these ratings and opinions in my w…

hypertension I Cant Believe It
I got SC 0 % for herniated disc C-6/C-7 and C-7/T-1 and Tiny facet hypertrophy at the C4-5 level resulting in mild neurol foraminal narrowing, reason: no pain in my neck. I got denied for TMJ, reason: pain in my jaw is caused from pain in my neck. I just had a thought that I have kinda played not on purpose the VA against itself :) Let me xplain . I have filed 4 claims, Initial claim Jan 05 I year time limit to BVA is coming up in May 2nd Claim August 05 adjudicated last month. Claim 3 and 4 asbestosis and PTSD just submitted Feb 06 and Today. So in the adjudication of the initial claims DRO review I got SC 0 % for herniated disc C-6/C-7 and C-7/T-1 a…

Two Hundred Eighty Three Days For Claim
The latest update on my claim has the phone clerk telling me it will take 283 days from start to finish for my claim to be processed. I guess they have been taking numbers to see how long the average number of claim will take to reach a decision at my local VARO. So if this is correct, then I shouldn't expect anything until May or June of this year. They have everything they need here in town, everything else is a part of my C-File already and the only thing I can think of is a C&P exam and/or IMO of my records. The rest of my medical files are at the VAMC. So why does it take so long for a claim to be processed? More to the point, why do they keep changing th…

ptsd Totally Clueless
Hi All, Kinda lost here but guess that asking never hurt too much. Hard to find a good starting place to begin this tale so I'll begin by saying that I was in the CG from 11Feb74-10Feb78 and was across the pond in the med on an isolated/restricted station when the broken arrow went down between the kennedy and the belknap in Nov75. just a little stress there. returned conus and went to a SAR station for the remainder of my tour. Been in some wicked nasty sorties plus did a lot of LE/Interdiction work under fire. Fast forward to 2000, had spent the previous 20 plus years being just plain miserable, moody, snappy, drank heavy for a while, most of you know the dril…

tinnitus Recurrent Tinnitus - If Both Ears Affected
Ambiguous DC 6260 resolved by CAVC In light of this Court's recent decisions in Stolasz v. Nicholson, 19 Vet.App. 355 (2005), appeal docketed, No. 06-7059 (Fed. Cir. Jan. 21, 2006 ), and Smith v. Nicholson, 19 Vet.App. 63 (2005), appeal docketed, No. 05- 7168 (Fed. Cir. July 11, 2005), the Board's decision was erroneous as a matter of law. Together, Stolasz and Smith establish that the pre-June 13, 2003, version of DC 6260 requires two separate ratings if each of a veteran's ears is affected by recurrent tinnitus, and that provision applies to all such claims pending prior to that date. Accordingly, the Board's determination that only a single 10% disability rating is…

How Would You Handle This?
An MD convinced me I was mistaken in failing to ask for service connection of Atrial Fib and Coronary Artery Disease to my ongoing claim for AO DM11. I was scheduled for C&P's so formally requested postponement awaiting new information. Also formally requested my military med records from the Houston VARO and NARA. This was 13 December 2005. Failing to receive the records from the VARO within the 10-15 day period they indicated (what a joke) I called and called getting different answers each time. Then I contacted my congressman, the VFW, the director of the VARO, the VA General Counsel in D.C and the Va counsel for Freedom of Info issues also in D.C. I heard b…
