Peripheral Neuropathy

Question

The VA gave me SC for peripheral neuropathy but did not give me the Bilateral Factor for the disease.they gave me 10% for each leg but that still left me at 92% .what do I have to put into a NOD to appeal this ? thanks geo422

Say you are appealing lack of application of bilateral factor to your disability. You disagree because you did not get proper rating. Spell it out for them in your NOD. Have you run the numbers yourself to see what you would have if they included the bilateral factor?

422, like John said or if you cannot work file for TDIU yesterday. I am at 94.5% and gave up on trying to get 100% schedular so I filed for and get aid get paid TDIU @ 100%. Terry

Another thing to consider. If you were tested at a VAMC for PN, have a private Neurologist test you. Most of the VA hospitals still use antiquated equipment. I was tested by the VAMC as mild and granted 10%. 6 months later I tested severe by a pvt neurologist and was granted 40 % bilaterally. Antiques don't work as well as modern technology. JMHO
