  1. Got my "NOTICE OF AWARD" letter today for SSDI. Applied 5 months ago and won on the first try. I am so happy. This is a big relief off my shoulders. They say I will get a check for my retro on Jan 5, 2007.

    My claim with the VA is currently at "Ratings". I have no idea how long it will be there. Should I wait for a decision to see if I get SC for my heart or should I contact my SO and submit my Award letter now.

    Also could anyone tell me when I will get Medicare? Is it 2 years from when I became disabled on Jan 25, 2006 or is it 2 years from my entitlement on July 2006?

    Any help would be appreciated.

    that is great news but please dont expect them to pay when they say... i was awarded sept.23,2006 and still waiting for my $$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$

They said as i was in the army at 17 i was to imature and had a personality disorder that caused my problems.. i said ok so the doctor said i was to imature to be in the military so instead of releasing me you sent me to Viet Nam ???? So then my problems are caused by you anyway... end of story

    I guess, after having finally found this, it kinda "begs the question" of how many vets have been found qualified to receive Social Security Disability, and yet, are NOT receiving P&T VA payments? I understand, of course, that the VA payments would not be forthcoming were the vets not "service connected", but, if you are "service connected" and you ARE receiving Social Security Disability monthly payments, then you are supposed to be receiving PERMANENT AND TOTAL from the VA.

    Now, that there sounds like a CUE if yer not, don't it?

    (of course, I am SURE that the VA, being as how they are supposed to be on OUR side, have properly taken care of all VETS that receiving SSDI)

    you know even when you think its over its never over when they owe YOU money... It took 2 1/2 years from filing for me to get a hearing which i won based on my having ((((4))))) doctors saying i should get SSD and of course on the SSD side one guy who i never meet saying no.. Well i won sept. 23,2006 and as of yet received 000000000 seems even after you win they stall . I was told dont worry sir you should be receiving your payments within Late jan or early Feb 2007 it takes 4 months to process the award? Maybe the SSD is hoping i will somehow die between now and Feb and then they can beat out the family or offer a 50% discount award

  4. Please give us more details so we can help this Vet that posted his VA rating experience. What was and is your life-circumstances and situation, please? Those facts would be helpful. Were you working, employed, good family life, good social life, etc? Did PTSD impact your life in any way? How, please?

    i started like everyone else i got 10% out the gate and then filed a NOD and started 2 times a month meetings one hour long... with the nurse , she just took notes and i keep going then she suggested i apply for a increase and i did . With her notes only i was bumped to 70% it was then my nurse suggested maybe i needed to go inhouse for a short stay ... i said no thanks and keep going to meeting (one on one) no group no anger management and then i applied for IU i was working at the time but my jobs were always spotty work a few years then stop or move and so on.. for proof i sent in my SSD report showing back 20 years my earnings... I got IU based on this showing a up and down work history. I wanted to apply for PT right away the nurse said dont do it wait a little less then one year and then apply ,,, i waited 10 months and got PT As for inpact PTSD had on my life i told the nurse what was happening i did not know what it ment i just said it... I shop at night when there are less people in line or the store... i have no friends to speak of.... I dont like crowds....... sometimes i dont want to see anyone or talk to anyone.... i put a lock on my bedroom door to keep myself inside and so i dont scare the kids wandering and looking out the windows. ...sometimes i have that dejauv... you know where you think something bad will happen and you are waiting for it to happen... when ever everything was going well i would quit my job and move on...............I have been married 3 times......... i wont go to a cemetary ........... And seeing animals hurt made me very sad but people less so....

    Dressing like a slob FOR a C&P, or not admitting you have contact with family members will not

    help you get a rating increased. Medical evidence, such as progress notes from yor doc is needed.

    i agree i went from 30% to 70% based on what my semi monthly progress notes and reports said.. i keep going to the meetings and then from 70% i waited a little while and went for IU and then waited a while and went for PT

  6. Beware that technically the money for children under 18 must be accounted for as it is for them. They actually have an annual form to fill out spelling out how the childrens money is spent on them.

    That said the kids cost more to feed clothe ans shelter than you ever get from SSA.

    that has always been the case look at the VA with their 66 dollars or the IRS even . Kids cost a lot anyway you cut it..

    March 21 - ALJ Hearing - Judge said in hearing he would approve - Stated why is this here should have been approved before this.

    May 30 - Letter from ALJ Judge saying "Approved"

    3 July - Money in the Bank

    5 July - Letter from SSA in Mailbox saying amounts etc.

    Filed in Sep 2000, Got money in July 2002. Just went thru paperwork and got approved to stay on Disability (VA P&T No Exam). Gee like I got better and went back to work (I would if I could).

    Anyway hang in there! My Son's money took about 10 more days after I got my money.

    thats what had me kind of pissed off ... my letter came sept.29 and just last week a guy calls and says he will be coming over to get my son to sign the form and i should receive my first check in another 2 months. and to let him know if i dont have my first check or back pay by end of jan 2007 and i started this stuff in Feb 2004 if i did not have VA what would i live on for 3 years .

  8. Rick you are right I live in NC and it is very hard it seems to get SSD here. I did get a letter from my Medical Doctor stating she in her opinion I couldn't work but the judge didn't mention that in her denial either. I will get another letter from my doctor that will be more precise and to the point.

    its all a crap shoot .. i applied in oregon and had 2 VA doctors and 2 IMO and all said the same and i had a report done by one doctor saying i can not work and still the state said i could work and their proof was based in three items.. one i was able to fly on a plane myself, two i was able to visit my children and three i did my application on line so that ment i was computer capable.. .. well my gaf scores of 45/45/50 so the AJ said i had so much on my side she was forced to grant even though she wants me to be reexamed in one year from start to finish start march 1,2004 granted sept 29.2006.. they act like its their money ...

  9. I was granted by AJ on sept. 29.2006 and was told to go to local SS office .. I went there and received some papers and was told my son who is now 18 needs to sign something? And i need to give them a Direct deposit form and to go home and the guy will call me... Well almost one month has gone by and nothing how long does it take till they start to pay you ?? And does anyone know what form they are talking about?

    One of the earliest vet benefits was giving veterans a prefered location from which they could beg for alms. (That MIGHT pay better than the current system).

    And lots of benefits are not really GIVEN to the vets - they are backloaded. Instead of paying the service member the amount they SHOULD recieve for their labor -- they "backoad" it -- by paying LESS to everyone - and promising benefits down the road for those deemed "deserving."

    So the benefits are paid through money saved by not paying the vets enough when they served.

    It is THIER money. It has always BEEN their money. It was just held back to pay them later (IF they are deemed "deserving")

I agree with you.... the old army i am sure you will all remember we started at E1 and about 90 dollars a month shee i could even afford to insure my car our pay was so bad,, in viet nam with flight pay and combat pay i got i think 218 dollars a month. What i get now is pay for services rendered and not paid for at the time.

  11. Free Representitives? In a case that is pretty clear like this would it be okay to use them? Also, does she need to do anything before she submits her info for the ALJ if she decides to use a lawyer or just the free Rep.

    Hire a SSD Lawyer well worth the money ,, i found one in oregon who is also a vet and 75 years old . He knows the ins and outs of the system and he keep up the pressure till i won but it took 2 1/2 years

    Have your spouse attend her ALJ as if it were just another day. Too not take her medictions because of a hearing could skew the opinion of the ALJ. ALJs do not ncessarily have to follow the letter of the law when making decisions. An ALJ can make a decision from the bench, go over the transcripts and send you the findings later on, or can make a decision by OTR. Meaning On The Record alone.

    So advise your spouse to take her medications when she goes to the ALJ. If they make her too drowsy and she cannot function it will be noted. But if she does not take them, it could be construed as an attempt to "look sick" and could result in a negative decision. If all your medical records are current and concise, the ALJ will have all that information. The ALJ will ask several questions pertaining to her ability to engage in activities. Then the ALJ will ask the Voc Rehab specialist if any of her skills are transferable. If they are not, then the decision will be favorable.

    You want to know how silly the SSD can be , in my case I had 4 doctors and 6 years of treatment on my side and they had one doctor i never saw in person say he thought i should be denied because i proved i was able to work at something like laundry folding .. he based his finding on ,, one i visited my children , two i was able to use a computer and three i took an airline flight all by myself.. its really sad how do they sleep at night seems they would rather starve you out , hope you will steal and get caught or work for food then give you a benefit YOU paid for with your many years of work

    Not sure how to word this , but let me try. I have been diagnosed with , and am currently being treated and on meds for the following:

    - Emphysema

    - PTSD

    - Type 2 Diabetes

    - Hypertension

    I called a law firm specializing in SS Disability and explained all my problems to them , and was told that I definately qualify for SSD (I am 52 yrs old) HOWEVER , here is the problem - I am currently working - I do sedentary security work giving out visitor passes at a local hospital - but still use many sick days due to diabetic complications , mood disorders etc..Both my personal AND VA Dr's are willing to give me medical notes stating I am not able to even do this type of work - and the lawyer said SS WILL NOT approve anyone who is CURRENTLY employed - but like I told him , I HAVE NO CHOICE , as if I take my Dr's orders and quit working due to my disabilities , how the hell am I supposed to provide for my wife and two kids for the six months (OR LONGER) while waiting for my SS claim to be approved ??? After all , the rent still has to be paid , as the electric , utilities , and we have to eat . Unfortunately , my family and I have no one we can move in with to support us while I wait for the claim to be approved , and we have only a couple thousand in savings - which would only last about a month and a half if we used it to "survive" .

    It's like a "double-edged sword" - the lawyer then sais , "Well , if you ever DO become unemployed ,give me a call ." My Brother got SSD for Diabetes with this same lawyer in about 7 months , BUT...my brother sold his house and was able to 'survive' on the profits until he was approved - hence , he didn't have to depend on any type of employment to survive.

    If anyone has any suggestions on how to get around this - it would be appreciated - as I'm sure there are MANY disabled people in the same situaation as me.

    dont think for a second they dont know the spot your in... i said the same thing i applied and it took 2 1/2 years and i barley made it with 4 doctors on my side.. if i wasnt getting VA how could i feed my children for a few years..

Well after 2 1/2 years of waiting i was finally granted a favorable from the AJ... after reading it close i am amazed seems i barley won , to my advantage i had according to the AJ 4 doctors one va and 3 others all saying the same thing i should be granted , and on the other side i have one doctor i never met who works for SS and he said i should not receive SSD based on my application and a pain survey they sent me.. NO exam verses 6 years and 4 doctors and it was a close call????????????? Well i did see the AJ suggested i be re-examed in one year i notice from everyone else this is a very short time period anyone have any insight on what will happen will i get a exam or a letter to fill out? If i will be getting an exam i have to line up lots of doctors to counter their one expert...

  15. Ah, so because I'm eligible for voc rehab, I'm not eligible for IU? Grr.

    I'll still appeal.

    But I'm doubting my ability to get it now. Damn.

    that could be the basis for their saying no... i applied for voc rehab and IU the same time and was denied rehab and but got IU

I get pissed that some of us with a 30, 50 or 70% rating have a much lower gaf score, much worse off diagnosis from doctors, saw 100 times more combat, got many more combat decorations than many that get rated 100% for PTSD just because they are in a different state or draw a different rater. It`s totally unfair to the highest degree. I know with my situation I would have got 100% if I lived in Puerto Rico and a few other places. In Puerto Rico you get 100% PTSD disability if all you had was a tire blow out on the deuce and a half you got onto at Tan Son Nhut airport in Saigon.

I started at 10% and bitched and moaned went to doctors appointments and keep NOD after NOD and after 4 1/2 years i made it to 100% I was also in the First Air Cav and while i was not a grunt but a door gunner i did get the pleasure of crashing 4 times but shot only once, and that was enoght for me... it will come just dont let them win by giving up

  17. At my ALJ hearing the Voacationational Expert agreed that I can't do my past job work. The Judge asked a hypothethical ? and he came up 3 possible sit down and low anxiety jobs. My lawyer responded with hypothethical ?s regarding my lack of being able to be supervised and not being able to stand or sit long. The judge immediately responded to my lawyer with what is the Basis of your hypothetical ?s and my lawyer said I am basing this on medical evidence and my client testimony. She allowed the ?s to which the Voc. Expert evenually ruled out all 3 of those jobs. I dont think the Judge wanted to hear that. My lawyer is skeptical and dont really know what to expect saying if it is denied We should be able to overturn at Appeals Council in a couple of months. Oh the wait , and they wanna know why People get depressed. Has anyone here know of anyone losing the ALJ hearing and appealing to Appeals Council and winning. The waiting from these claims should be be enough to file for Depression alone

    Kenny you came this far... i applied in march of 2004 had the two turn downs hired a lawyer and was still on the waiting for a hearing list when the lawyer call last week and said YOU won your claim so it takes forever and it sucks but letting them beat you sucks even more.. if ever there was a reason to live a long time its to get what you were promised ... live forever just to spite them

  18. thanks to all of you for the info.... i do not really remember if i ever gave them bank info on direct deposit or not so i will find out when i get my award letter... and i think a letter i wrote to a congresswomen in oregon who is really a supporter of vets ( check her votes ) might of helped because i won the award without even having a hearing . my attorney is Richard Sly of oregon a vet also and the congresswomen is darlene hooley so if your from oregon and having trouble they helped me.. manybe they can help ;you .

  19. WEll after 2 years and 9 months my lawyer calls and say... YOU won your award for SSD.. Well i am of course very happy but now i am very confused... The lawyer says i will mail you the judges desision. So my questions are , when i filled out the claim in 03 2004 i listed my minor son who lives with me and i have custody of but i did not list my minor daughter who lives with her grandmother , although i support her every month (long story) i felt at the time she did not live with me so i could not list her . Well now i find out she can also get an award based on mine so my question is How do i add her and my second question is how will i get my award paid to me? Will they SS send me a form to fill out asking for a Direct deposit number? Or will they send me a check? or will they wait for me to ask for this information?? Also i was told a long time ago i would receive $1190 a month in Oregon and my son would receive 595 a month how will that work with adding my daughter will they cut my sons award? He just turned 18 but my daughter is still 15 years old? I know its a lot of questions but i sure could use a few helpful hints.. thanks everyone robert51

  20. Well, the brown envelope came today but for the second time I have been turned down at the ALJ

    This time the judge says"he is giving little weight to what my VA dr. had to say about my Condition.

    The first time I went that judge said"he opted not to beleave'' my then civilian DR> In his report he stated

    that I am not creditable , I guess at the hearing he asked me if I was in the service and If I were in

    Nam . I told him 3years and yes I was there. He asked if I seen action . I said" rocket attacks , ambush rocktet attacks abush" <just like that. In his report he states "I did not mention sniper that I had mentioned in a 2001 Va Report he read someplace. SO I guess thats why he finds me not creditable. Hell there are alot of things I did not mention about my time there but is that a reason to say that about me! Bastard!

    He did agree I have PTSD but he says its not that sevear. I think this guy was using a viberating butt plug.

    Dont give up my case is the same as yours 70% PTSD and IU and PT i applied march 04 had the two turn downs and was just informed by my lawyer i was granted based on my long term doctors treatment been seeing doc now most often 2 times a month from 99 on... the thing that pushed me over the top was a form the lawyer sent me that they use to see how you are as for expected to miss work how many times etc you have your doctor fill out .. can ans. good fair, or poor about 40 questions

  21. Substantial Gainful Employment has nothing to do with the amount of money one can make. The VA will flag IU vets who earn over $6K per year, but the definition only applies to your ability to perform employment functions. I had a IU veteran from my Vet Center earn only $1000 one year and was called in to determine his fitness for employment, and have had others who made more and were never called in.

    SSDI had a "Ticket to Work" program that allows you to earn up to the poverty level without losing benefits. However, if your IU and receiving SSDI, the Ticket to Work Program would not be a good idea.

    i am still waiting for SSD i filed an appeal in June of 2004 and was told by lawyer that oregon is behind but really this is a bit much in the mean time i have had 3 different Doctors turn in reports to support my claim but so far no go... IT is really shitty that on yours side you can have doctor after doctor say the same thing and on their side i have not even seen any medical people but still they just keep stalling and stalling hoping and wishing you would either go away or just die
