  2. Do you have that in writing, hard copy?! If so, then you can appeal. In the meantime, there must be some public law passed before they can recind gratuitious benefits. This is news to me. I'd like a little law in fact to back up their actions towards you. ~Wings

    i have an id card myself i got it in oregon a few years ago i was trying to get one for my wife and was sent a letter by the RAO and that was in the letter from DEERS/? sent to the RAO .....i wrote back and asked if there was something in writing saying my wife can not have a card because of my rating so far no reply....

  3. *Please note that DAVs MUST HAVE A COMBINED RATING OF 100% TO BE ELIGIBLE. DAVs receiving 100% because of unemployable status but whose combined rating falls below 100% are NOT eligible. No exceptions will be made.

    In order for dependents to receive an ID card the sponsor must be present, if not, the dependent must meet one of the following conditions:

Any input on is it possible to go for 100% PTSD ... i heard if your 70 %IU PT for PTSD you are almost thought of as 100% .. really because there is only 70 or 100 seems like a bad deal ... i have two different reasons.. First i am thinking of moving to a state that gives benefits for 100% ....... and second if there is anything i think in the furture that can give me heartace its the IU i just dont trust the government and think its possible some day they will try to take IU after you reach 65 especially if your getting SS and VA ... anyone every went for 100% PTSD i still see a doctor every 2 weeks and have for years and my meds have climbed to 650 a day Serquol and 150 Zoloft.. Anyone know of a down side?? I dont think with my doctors reports they will try to lower my rating .. i have been 70% for 6 years now.. input anyone...

  5. Ladies and Gents, he just wants FACTUAL facts. He doesn't want speculation. He only wants to hear from someone that has gone through EXACTLY what he is going through.

    Having helped straightened this out......I'll paddle on, downstream, for I hear the fishin is better down there..... :rolleyes:

    the way i see it is he wants to know if he does not go to this treatment or any other will it affect his rating ... FACT yes it will ... if you do not take your meds if you do not take the doctors advise you will put your rate at risk ... Becasue i contacted a doctor on my own and did not go thru the VA They tried to re rate me.. if he dont want that program pick another ... i did not go to group i never liked it and told my doctor i would rather have a one on one and i got that in Portland VA for 4 years till i moved i saw the doctor 1 time a month and a nurse one time a month.. what i see in his message is he does not want to go one on one and he does not want to go group.. it does not help him and i understand that .. but big brother is the one who sends the $ so big brother wants us to play by their rules ... right or wrong they still want it their way and they are willing to make your life one big bad day if you dont comply... .... sad to say but remember the saying ... The one with the gold makes the rules...

  6. I'm sorry but your the first person that I've ever heard that took 2 1/2 years on an initial decision. An initial decision usually takes between 3-6 months and then if your disapproved and ask for reconsideration this is where the long wait usually happens.

    the 2 1/2 years was for apply to AJ approval but really i was already IU from the VA i already had 4 doctors saying the same thing and still SS let it drag out as long as they can ... i never saw a SS doctor the reason for my first and second rejection was according to the SS people as long as i could look up my meds on a computer and as long as i could book my own airline flight i was not so disabled to get SSD

    and somewhere out there was a job i could do.. what gave me an appoval at AJ was my doctor said i could not work at any job full time.. with the clincher the words full time...

    Looking for FACTUAL comments concerning my recent post about being told my psychiatrist appointment being cancelled, and told appointment made for me instead with the trauma recovery program. I/we can speculate all day long--I want input from those that are familiar with the program, or attended same. Would like to know what would happen if I indicate to those in charge of the program AND my psychiatrist that I do not/will not attend ie... do I have a say in my mental health treatment without jeopardizing my current status/award?

    same happened to me and they will try to re rate you if you do not go.............. you either have to see a shrink a few times a year the rest of your life or else expect to do battle over and over ... i told you in more detail on another of your post..

  8. My psychiatrist cancelled my appointment ( I had been seeing him every 6 months for 2 and 1/2 years ), and instead I received a new appointment to attend the trauma recovery program. I have come to accept my illness, and am ok with taking the prescribed meds. and living the life I have been delt. Seeing the psychaitrist 2Xs a year is enough. I do not want to attend/participate in the program ( Trauma Recovery ). I have already attended one of the Hospital's courses---group course, met 1 time a week for 8 weeks, run by a social worker. I do not do good in groups.

    Do I have the right to NOT participate/attend this program. If I do not attend/participate, will my benefits/award be in jeporady? How do I go about letting the Trauma Recovery Program personnel know my feelings about this without getting screwed. Is there a person at the VA Hospital that is supposed to help vets that find themselves in this type of situation? Iam not ducking anything, but what good is a program like this going to do for a guy who suffered with PTSD for 40 years? As you can see from my profile, Iam 100%IU ( P&T awarded last year )59 yrs. old. How do I "opt out" of further MENTAL TREATMENT by the VA hospital, and still maintain my other medical benefits and my award.

    dont know ... i was made 70% IU and PT in late 2004 moved to the philippines in 2005 with wife and kids.. becasue there is no VA here on the island of CEBU i chose to see a doctor on my own 2 times a month just to unload and i guess to share what is in my head... well the VA must of thought ... we got you ha ha ha you are not getting treatment and sent me a ... New CP to see if you still are rated so and so or you will be re rated.. well i got a report from my doctor and took it with me to the CP and blew them out of the water... so they are sneaky if you stop treatment they will assume you some how cured yourself... dont let them do that to you ... keep seeing the doctor at least 4 times a year ...

  9. Hi, I'm just wondering how long will it take to get SSDI, once I get a lawyer. Do I have to get my doctor to say that i'm disabled. I have 10% disability due to generalized anxiety disorder. But since then it has gotten worse. I haven't worked since july of 2006. I haven't been to mental health yet, But i made a appointment for December 11th. What do I need from the doctor? Please give me time frame, once applied for, roughly?

    well if you looking for the truth here goes... in my case i applied for SSD after i was 70% and IU and it still took 2 1/2 years to get approved ... its really sad a country that can spend a cool trillion dollars on iraq and have army bases in Korea Japan etc etc etc.. will claim they have no money for the men and women who make their freedom possible.. I think to make our military strong they should draft all the highley educated son's and daughters of these leaders who send us in harms way .. Then they can grasp the true meaning of loss

  10. I think that Sen Dole is an honorable man and definitely was one of us but he made a good and comfortable life for himself and is out of touch with Veterans issues. He probably does not even know what he is paid by the VA now.

    i found his web site and told him while his work on these issues is good he really needs to walk in our shoes to see how it really feels when he says US older vets need to give more to the younger ones... If they can spend billions and billions on Iraq, troops in germany , japan , korea, etc etc.. then they can find the funds to give to the vets who made freedom a reality ..

  11. State of Arkansas Department of Veterans Affairs

    STATE BENEFITS:

    A. Homestead and Personal Property Tax Exemption: Arkansas Veterans who have been rated, by the VA, as 100% service connected (Permanent and Total) or awarded Special Monthly Compensation for loss or loss of use of one or more limbs total blindness in one or both eyes are entitled to exemption of Homestead and Personal Property Tax. Widows, so long as they do not remarry, dependent children, during their minority, continue this entitlement. Widows, so long as they do not remarry, dependent children, during their minority, are also eligible for this entitlement if the veteran was killed or died in the scope of his military duties, is missing in action, or died from service connected causes as certified by the Veterans Administration.

    B. Gross Receipt of Tax Exemption: or gross proceeds derived from the sale of motor vehicles and adaptive equipment to disabled veterans who have purchased the vehicles or equipment with the financial assistance of the Veterans Administration as provided under 38 U.S.C. 1901-1905 (AR Code 26-52-401 (7) et. seq.) Gross receipts or proceeds derived from the sale of a new automobile to a veteran who is blind as a result of a service-connected injury. Registration will require an entitlement letter form the VA and will be limited to one new vehicle every two (2) years. This exemption defines automobile as a passenger vehicle or pick up truck but does not include trucks with a maximum goes load in excess of three-quarter (3/40 ton and does not include any trailer. (AR Code 26-52-415 et.seq)

    C. Income Tax Exemption: provides an exemption of the first $6,000.00 of service pay or retired pay for members of the Armed Forces to include Reserve Components or for retired members who are residents of the State of Arkansas.

    D. Arkansas Department of Parks and Tourism: Arkansas resident veterans permanently service connected at a 100% disability rate may camp for half price in Arkansas State Parks. Proof of 100% status is required.

    E. Arkansas Game and Fish Commission: Resident 3- year Disability Fishing License- RDC ($10.50) entitles all 100% totally and permanently disabled persons privileges of the Resident Sportsman's License (hunting) and the Resident Fisheries Conservation License (fishing). HIP registration is required to hunt game birds. To hunt waterfowl, state and federal waterfowl stamps are required in addition to HIP. A Trout permit must also be purchased to fish in certain waters. Certification will be accepted from Social Security, Veteran's Affairs or Railroad Retirement. Proof of one year's Arkansas residency is required to apply for this license. Valid for three years from date of purchase, recertification is required for renewal. These two licenses are only available from the Commission's Little Rock office. If you wish to purchase a license, bring proof of one year Arkansas residency, such as driver's licenses, state ID, property assessments, Arkansas state income tax forms and acceptable proof of disability. Applications and information are available by calling 1-800-364-4263 or (501) 223-6349 in the Little Rock area Monday-Friday, between 8:00 a.m. and 4:30 p.m. 3-Year Disability licenses are not available by phone order or online.

    F. Educational Benefits: Arkansas Department of Higher Education (ADHE) has the authority to provide free tuition and fees at any state supported college, university, technical school, or vocational school; to the wife and children of any Arkansan who has been declared to be Prisoner of War or placed in a missing-in-action status since January 1, 1960. The same provisions apply to the surviving spouse and children of any Arkansas resident killed in action since 1960.

    G. License Plates: The Revenue Division will provide (upon receipt of proper certification letters) a number of special privileges and benefits for Arkansas residents, including special license plates for Congressional Medal of Honor recipients, Purple Heart recipients, Ex-Prisoners of War, Disabled Veterans, Pearl Harbor Survivors, Armed Forces Retired, and Military Reserve.

    some states say 100% and that is what they mean ... not 70% and IU PT... so what does this state mean by 100% is IU included

  12. I'm kind of curious about the letter I recieved that states they will make a decision on my non-medical requirements soon. Second notice to come? Is it typical to receive this second notice or does that mean there is an issue with my work credits and it will get denied?

    I had an in office visit with SS and was denied first, then hired a lawyer, as I didn't have the patience to deal with the SSDI office as dealing with the VARO about sent me off the deep end for good. Unfortunately for me my attorney is out of the office this week. She stands to make about 12-18 grand on me, and she is out of the office? LOL. Oh too much.

    Does anyone know if the Lawyer gets to take 25% of the back pay for my child? Just curious about that, I need that money to pay off my adoption loan.

    in oregon they (the lawyer) gets 25% OR up to 5,300 which is the max they can get ...

  13. Here is one reason I feel a veteran is a veteran at enlistment for bennifits purposes.

    I know a kid right now that is emotionally unstable but has enlisted in the marines. The marines KNOW he is unstable as he was hospitalized for attempted suicide while in the delayed entry program. He was admited to a mental health ward. The recruiter visited him while he was recieving care. They are going to put him in service.

    Obviously this is a pre-existing condition. Obviously he is not fit for duty. He will fail, I promise.

    Once he begins training he belongs to the DOD. Let's look at it like buying a car. The DOD needs cars (soldiers). In this case they have knowingly bought a faulty car (because new cars [soldiers] are hard to find). In my view, they bought it, they own it.

    This kid has hid nothing. He has tried to opt out but they lie and tell him he must go.

    When he returns in much worse shape, I will do everything I can to ensure he recieves benifits. They bought him, they can pay for repairs.

    I started a thread on this kid some time ago. Some may remember it. I got some really good advice from a couple of board members. Unfurtunatley, to these friends of mine, I am a friend, but they see the recruiters as having authority. Who do you think they listen to? They listen to the recruiters that threaten jail. So the DOD bought a faulty car with their lies and will have to be accountable for it.

    when i first applied for disability in 2000 i was told ,,, according to your records its says in a report written by your drill sergent in 1968 that you showed signs of inmaturity in basic. and this claim could be denied based on your pre existing problem... So i said ok , i was inmature at 17 in basic but allowed to enlist and you knew i was inmature in basic then why did you not send me home? But instead at 18 years and 4 months old you sent me to Viet Nam?? was i to inmature in basic but mature enogh to be sent to viet nam, now that does not make much sence does it

  14. Perhaps the VA doc that made these statements to your private doc has read or participated in this study. I am not in agreement with the outcome of this study.

    well that was a bunch of bull if i ever read any.... hey there is a fix to this PTSD and that is ... send only the highley educated and rich to war then they being so smart and rich will not want or need any type of help or comp....

So i have been seeing a doctor now 2 times a month for 2 years and she wrote me a great report that helped a lot to get me SSD a year ago and this last time i am in her office and i know she see's other PTSD VA patients as a sub contractor ... well i get part of what i spend back (VA pays cheap ) i get about 1/3 back of what i spend to see her as a private doctor IMO ... by submitting her bill to me and a report to cover my seeing a doctor for a service connected disability twice a month... This session she says to me the VA doctor called her and told her (((( Many vets get on disability and get used to the income as many of them did not hold good jobs before so they the vets tend to want to stay ((( collecting ))) like a retirment for ever and vets can be very good at making something little seems like a big deal... I say... remember FTA well for me its FTG ... i told my doctor if you are going to start acting like a va bean counter i guess we should part ways... This is why a vet has to have the right to have a lawyer ...

  16. I think the report will be on the shelf gathering dust. Major increaes in compensation won't happen or will be vetoed and major cuts will not be tolerated by congress so nothing happens.

    i think the key word is ((((up to))) first they will say ... ok we cant afford this you know with all that is going out for Iraq, military presence in Korea, giving to iran and north korea to make american safe and dont forget our problem in mexico and of course our military presence in Philippines and Germany and our aid to Africa, did i forget anything... so with this in mind we are going to give a well deserved amount just not now... so that is out of the way now we are going to need you to give us something.. this is how it will most likely go...

Robert when they discuss lowering benefits thay are talking about the people filing in the future, in my entire life I have never seen anyone lose the moeny they were already getting but newbies get lower retirement deals all the time, many automakers now have "temps" that work for half wages and they have people lined up for the jobs 14.80 an hour is better than minimum wage. I think the talking heads on TV forget to take that fact in to their speils "grandfathered" means somethign when it comes to federal checks when you are on a "fixed income" and your lifestyle is set to that it's not exactly kosher to take it away and I have just never seen it before JMHO

    i agree with you on the percentages and SS but the IU is really a push how would IU be grandfathered? if you receive it now you will get it for life? Seems more to my logic the bean counters would say .. ok your percentage is yours because your hurt . your SS is yours because you paid into it.. But the IU well you dont need it if your getting SS ... I think giving only 70% for PTSD instead of 100% forces most of the vets with PTSD to either get IU or dig up some secondary things.. Notice how they are real careful to say... Quote... YOUR 70% but we will pay you at the 100% rate because your IU .. so after you reach 65 they could say ... oh well your 65 now so collect your percentage and your SS ... goodby... what will happen is many guys will be forced to try to find a way to make money , Many of the 70% PTSD guys with IU have no SS ;to speak of or very low earnings at best ... so lets see 70% pays 1100 and if you have any SS and its low maybe another 600/ well times will be very tough... My doctor wrote a report for me last year and said she though i should not handle my money and i sent the report into the VA along with my yearly ( are you working form ) the VA called me and asked me if this report was a supplment to my already rate or was i looking for a new claim .. i wonder now if i should of tried for 100% PTSD or would i get a new CP and lose what i already have...

  18. i started out with the Zoloft 100mg and a serquol? 300mg and now i still take the Zoloft but i take 650 mg of the serquol and sometimes i just cant wake up ... like i am unable to keep my eyes open ... it passes in about 3 hours ,,, how can anyone work when they get like that i mean one time i was driving very early in oregon and next thing i know is a cop is waking me up and i am in the center grass i dont know how i got there... i dont drive much anymore...

    That sounds illegal, let alone sidestepping "due process"...if the vet is still alive and entitled to receive his/her checks, even if he/she "disappeared" to live in another country as some vets do.

    Can you cite some cases where this has happened?

    well i moved to the philippines and of course the VA here is a plane ride away for me so i started to see a private doctor 2 times a month and a year goes by and the VA sends me a letter saying they are setting up a CP for me ... i am over 55 70% IU and PT so i had my doctor write up a report and i brought it with me and i was in and out .. but if i did not have a report or did not see a doctor i am pretty sure i would of be looking at,,,,,,,,,,,,,, oh your cured no need to keep sending you a check..

  20. well i was thinking the same way i could make a claim for hearing loss and most likley win and my doctor keeps suggesting the sleep study dont know why she would but i am guessing its tied to PTSD ? I really did not want to go thru the drama and bull filing another claim and i dont want to add to the wait times.. i guess i will wait and see in the next year of so what happens... i do wish PTSD had a 80 and 90% rating instead of 70% or 100% with no between... another thing that seems to be very much in the VA favor is the amount given for 70% and even 90% is so far from 100

  21. i saw it on a news program and it was said lowering entitlements was one of the ways to address the problems with the weak dollar and the ss shortfall .... When you think of it which would be the hardest to sell to the US people...raise taxes or drop such entitlement programs as IU and back it up with the .... dont worry these poor vets will still get thier FULL SS benefits just like all americans.. I think of all the ways it could go IU for a vet already collecting a percentage and SS is an easy sell by the powers to be... Its like collecting IU when your 80 years old how many people are still working at 80? I just think taking away a vets IU when he is collecting SS and is over 65 would not be hard to get passed the public. I am still 56 and just looking to the furture . I was just wondering if i should start the long process of trying to get the other 30% now instead of waiting , maybe because it does not affect bottom line the raters will be a little easy to give it ..

  22. well there was talk of that by Bush in the new report that was made up that VA entitlements should or could be stoped at 65 when SS kicks in but most guys on IU dont really have the quarters for SS to begin with ..... also reading the new's on SS short falls and they say either we need to raise tax's or cut bennies... and with the weak dollar which had some of it strenth based on stock market and equity in housing which is now not a driving force, the new's said the only way to make up for shortfalls is raise tax's Or QUOTE .. SLASH GENEROUS ENTITLEMENTS... and with me getting IU seems i could be one of the so called Generous entitlement types they are talking about...so i am thinking maybe i should try for a 100% without IU
