    After they denied me my increase; Only new evidence I submitted was a form with questions answered by my ptsd doctor that my lawyer sent me. (Residual Functional Capacity Evaluation) Hygiene I think I am clean; aside from having untrimmed facial hair and my hair will get shaggy from lack of hair cuts.

    Something I over looked that might be important is my PTSD isn't rated solely as PTSD. E-Ben has it as PTSD with dysthymic disorder.

    MH Clinicians are coming under extreme scrutiny, as they should, in regards to what they Knew, when they Knew it & what they did about it. Everything you tell them, is documented in your VMC or Private MH Med Record.

    Not sure of this, I don't think there is any VA Reg precluding a VA MH or PCP Clinician from completing a MH DBQ and submitting it to the Rating Dept, even if the Vet didn't request it.

    The prospects of that could cause a Vet some real problems, not just with his guns, think Fiduciary Appointment.

    The RO must have decided I am competent. E-ben has my backpay listed in payment section. Still sending in my ptsd doctor's letter that says I am competent just to be safe.

    If you want to off yourself, right or wrong, US society will want to stop you. I'm just concerned about the possibility of you injuring physically or mentally, an innocent person (civilian or PO) in the process.

    That time in my life was hard. Near the start of my process with the VA in 2010. Point is, I didn't lose my rights to own firearms.

    No. I told my doctor I have those thoughts. He asked how I would do it. I said i'd get a cop to kill me. I still own firearms. I have always been 100% truthful with the VA and I advise you to do the same.

  5. I just got a 2nd SSOC for my PTSD increase...

     

    The rating decision dated 9-28-16

     

    Decision:

    1: Increased evaluation for PTSD curretly 70% disabling is increased to 100% disabling effective 2-1-16. Increased evaluation prior to 2-1-12 is denied.

    2: Entitlement to IU is denied.

     

    My lawyer is taking care of this, but when should I expect my first 100% monthly check?

    You need nearly that exact sentence broncovet wrote. Raters look for it the same way they look for any one sentence to deny you the first time around. IE: I was denied an increase for PTSD because, when I was asked what I do in my free time,  I told the C&P I play PC games. (I kid you not) The C&P wrote that playing video games suggest some work can be done. But I am now being granted 100% after appeal.

    If you are already compensated for PTSD, you dont need to prove you have it again, etc.

    I think it was just a check (for what reason, unknown) to make sure your eligible for VA benefits.

    E-Bem has it at Appeal pending notice of disagreement; however, I got a SSOC in the mail saying they're denying my IU, but granting 100% for PTSD in a separate rating decision. #800 number people said they're working on finalizing my 100% and gave me the generic time frame of a day to months depending on workload, complexity of claim, ect, ect.

    We really want to get a 2nd car. I don't go out when the wife is at work, but it would be nice to have that option. Especially with our son is starting kindergarten next year. Other than that; it's get past bills/loans taken care of and work towards having the credit score to get a VA home loan. Plus, a smidgen will go towards a better Christmas for our son.

    Can you scan and attach their reasons and bases and evidence here for that older decision?

    If they knew you had SSDI solely for PTSD  and also they had an authorization form signed by you  to get those records, it is a CUE if they did not consider you for TDIU in the last decision.

    I should certainly think so but the letter will tell you more.I hope you can scan the new award as to Reasons and Bases as well and attach here,too when that arrives.

    It is the actual words of the VA in decisions, that often ends up biting them in the a--.

     

     

    I will see what I can do. My main concern right now is making sure this is real. (100% rating) Just seems unreal to me right now.

    This concerns me:

     "A review of your VA file notes you have been assigned a 100% eval for ptsd based on your exam dated [date]."

    Why the exam date and not date of claim? You will know more when the award comes but it might not be much retro....and retro is always good if some of it is squared away for a potential IMO/IME, like for an eventual  P & T designation.

    Great news anyhow! I probably asked you before but do you get SSDI and is it solely for the PTSD and/or SC disabilities?

    Also, if you were unemployed when they gave their last award, did VA know that and if so, did they consider you for TDIU at that time?

    The VA knows I was unemployed when they awarded me the last time and that my SSDI is based solely on PTSD. Shouldn't the back pay be dated to at least when I requested an increase from 70%?

     

    edit: the exam date is a reference, i think,from a listed exam under evidence. I just didn't type it all out on here.
