  1. My brothet when i went to my DRO Hearing i brought all they had and then as much paperwork i could come up with. Back up your case and bury them with proof. I dont want to discourage you but my rep said nothing at all ...yes really so dont depend on anyone. Remember that the burden of proof is on you. Good luck and never give up

  2. Tdubya82 I got awarded GERD for going to medical while I was in for heartburn and reflux back in 1990. Then have seen my own doctors for it since i got out in 93. This included gastro reports of upper gi and endoscopy. So it was from time in service to now. But I think the hook was that I filed the claim for it under Gulf War non specific . Gastro problems is now listed as one of the symtoms along with heart and many others. I too was denied once years ago for it. I am located in NY near the city downstate.

  3. Hey guys I think I have a unique problem I def need help with. Here goes..I had a claim for Gulf War Syndrome non specific. The claim included gerd , svt and afib for my heart and joint problems with my left foot that was broken in service on duty. I was sent for the c and p exams . I have a copy of all of them and they all found in my favor. I recieved the big envelope and they awarded me 10percent for gerd and made no mention of the other claims at all. I called the 800 number and and was told the 526 form ? Was never filed for the other two claims. So i have now filed them and uploaded the copies of the c and p exams results and al letter explaining what had happened originally. I look on ebenefits today and see that they want proof of my earliest records of Gulf War Syndrome. My question is what the hell do I send them? I am already 70percent for PTSD and 10 for gerd. They have the results of c and p in my favor and all records from my time in the USMC to present doctors attatched . Thanks for any advice.

    Mike

  4. Thank you brothers . i have been thinking about it and all of it was part of a claim for Gulf war non specific. Iam thinking that only the GERD falls under that category. So if the rest were denied i will resubmit them as separate claims. All have nexus , all are service connected in my service med record and all have had C and P exams. So they are complete claims. Once again it should be a no brainer....But as we all know...lol !

  5. When you turned in your claim, did you have any MD provide a nexus saying that these conditions were Service Connected?

it may seem to be a no brainer to those of us w/common sense, but the VA doesn't have regulations covering that.

Yes I did. For all of them. It was alot of work and alot of running aound to get it all put together and then bring it to my primary at VA Northport NY prior to the CP exams.

  6. I would wait until you get the envelope. Trust me. Ebenefits is not always reliable. I can personally attest to that. I am service connected for one thing and it doesn't show on ebenefits at all and I never got a envelope. I found this out two days ago with 18008271000 or peggy.

I do appreciate it . It can make you nuts if you let it. I gave them med records going back to 1994 including 2 heart ops in 99 and 2007 for the heart and in my in service records my VA doc found a bad ekg from 1990 while in the Usmc . I figure its a lock. I will wait for the package from them. As far as my left wrist well it was broken in service in 91 and have had problems since. In my C and P exam the doc told me it was misdiagnosed and i need to have surgery on the wrist. Again ...why would that be turned down ? I should be used to this it was a 6 yr fight in my appeal for PTSD. But i finally was awarded it. Thanks for the input.

  7. Hey all, I was looking on ebenefits and see that my claim is complete but of the 3 service connected only one for GERD is showing awarded 10%. The rest are heart SVT and Afib (started in service ) and wrist ( broken in service ). Is it possible they will show at a later date or after all the submitted proof and C&P exams did I get nothing  ? Did not yet receive my big brown envelope

  8. The appeal took almost 5 yrs. And it did not go to DC it was a DRO review that I chose at the time, I thought it would be quicker and it would also give me the opportunity to go to DC with it if things went bad. And it was my DRO that called me not Vet service officer. He had called me earlier in the month to send me for another C&P exam for PTSD and he told me he would call me with the end result when he made his final decision.

  9. Hey brothers and sisters ! Just went on ebenefits and under appeal status it was changed to " no info " and under the date of my NOD it now has a new entry with todays date and SOC { statement of case } next to it. for 4 yrs it hasn't changed. The SOC I assume is from my intial denial from 2009. What does this mean ? Good , Bad , Ugly ? Is it finally being worked or rated ? HELP !

  10. Over 2 weeks ago went for a second C&P exam at Va Hospital in NYC. My DRO is still waiting for it to come back to him so it can be rated and completed. After a six year wait on my appeal and many exams this feels like an eternity. So today I call the hospital itself and was told it was sent back to RO in NYC a week ago. Then the gentleman tells me that it is probably in the mailroom at RO and no one has opened it yet . C'mon , I know we all have waited and waited for many things from the VA but this seems excessive ! Can I go to RO personally and ask for it and take it up myself ? Or can someone offer advice on how to get them to open the mail ? As always thanks for all the advice.

  11. Thanks all . I am new to all of this please bear with me, I have a family and I am afraid of going without medical benefits for them. how would this work ? I know I can ask my VSO but everyone on here seems to know just a little more than they do......Also is there anyway I can view my C & P exam results online ?

  12. Hi thank you all for your advice in the past it is always helpful.

I am hearing conflicting info from the vets I come across at the local VA waiting rooms about a final rating for service connection on multiple claims. I have an appeal in for PTSD as the primary and GERD and A-FID/SVT for my heart as secondary. I am already getting 10% for Tinnitus. So if all three from the appeal are awarded how do they come up with the final monthly award ?

    Thanks for your help

    Mike
