  1. Hypertension manifest during the first post service year and a MD stating their opinion so.

    The BP readings must be compensable if not shown in service.

    Compensable means that it is at least 10 percent disabling.

    BP readings predominatly 160 sys or 100 diastolic.

  2. Actually it is c3 with accessory nerves to c4 and c5. The Diaphragm is innervated by the Phrenic Nerve.

    I have Speep apnea and Phrenic Nerve paralysis associated with the cervical spine. (Service connected) and am having to fight for the 100 percent based on Pulmonary hypertension.

    You should have to have an EMG stating the phrenic nerve and diaphraghm are effected. Be aware that

    having needles stuck into your diaphragm are no fun and very dangerous.

  3. A chemical stress test involves using a radioactive isotope such as thallium. It is injected into your arm and you wait for a an hour. Then they put you under a scanner to scan your heart. After that they inject you with a medicine that causes the heart to race. Once they reach a certain level, maybe 130, then they give you a shot and slow it down and you are placed back on the scanner.

    I hope all goes well. If they find sometiing, they most likely will do a heart echo and cath.

  5. Well I really don't know what to do. I have a SOC from my NOD. The SOC was a partial grant but also didn't even mention several of my other issues. They gave me the SOC prior to the 60 day I requested for time to submit new evidence.

    Rumor is my file is at final authorization stage. Also told this could take 45 days. My 60 days to file Form 9 runs out in a few weeks.

    So, do I do a Form 9 and list everything they didn't cover.

    Do I request a reconsideration on the basis of my new evidence form VA exam?

    Also what should I do about these 2ndary conditions that the VA Dr found? File a new claim?

    I am in the process of getting rid of my POA since he was not help and thinking of switching to DAV or really to no one at all.

    1: If you have a decision on any part of a claim, even though it is not complete, fill out the form 9 snd submit it. You will receive another SOC stating you can also have a DRO review.

    2: Very important: The unmentioned issues you have may be waiting at the RO for another decision. Now this is where it gets complicated. The VA can let the 1 year time frame expire on a claim and t he claim is deemed to have an automatic denial. So if the other claims are close to the 1 year point, Send an IRIS questionaire. If your answer is not satisfactory to you, I would send in a Statement of case and mention that if you do not receive a formal decision on the issues and list them each, This is your official notice of disagreement.

    That is what I would do.

  6. Huskerfanfl, you are fortunate because the louisville RO is now one of the Best in the country for claims. It wasnt always that way but Now the Service Center Manager seems to be very good.

    Be sure to get your disabled Vet plate for your vehicles. Just take a copy of the letter with you and show the court house.

  7. Here is what you can do to get a fast response.

    Call your VA and talk to your Primary care docs nurse.

    Tell the nurse that the VA stopped the plavix and you would like the nurse or primary doc to send an email message or a note to the Cardio doc. Get the cardio doctor to re-write the prescription.

    Usually you should be seen every 6 months or so by cardio.

    It may not be the case for I am SC for heart disease and have seen only 1 heart doc (Stress Test).

    This should clear it up.

    Another thing is if you have health insurance, Then you need to contact the patient Rep at the hospital. Explain that you are a Veteran but you are also a paying customer and there is no reason to cut off your meds for budget purposes. (Bottom line)

  8. Jecsb54, a MD stating at lease as likely as not: should envoke the benefit of the doubt rule. But it is not always the case. There are several factors to look at. One is if the entire file has been reviewed or not. In the case of a C@P exam, if the doctor states the entire record has been reviewd or it is in VA format,you should have no problems.

  9. Remember, effective dates state: The date entitlement arose or the date of claim whichever is later. In Chuckles case it should be the date awarded SSD benefits.

    Jangrin, file a NOD as to the fact that the benefit arose on the date SSD was awarded and attach a copy. They most likely will change the award as they review the claim.

  10. The address problems are a clerical error as someone has not corrected the address in the system.

    Any Vet that is SC and meets the criteria for IU should file for IU.

    Now a good way to do that is to complete the form for IU when asking for an increase and wording the claim like this:

    I am filing for an increase for service connection for (your disability) to include TDIU.

  11. On the denial letter the VA stated the records were negative for Hypertension and headaches when in fact there were 7 compensable blood pressure readings and a diagnosis and also Several reports of Migraines with treatment and diagnosis.

    They tried to cover their backsides stating inferred claim.

  12. Its like a C@P exam where he only reviews the records. It is a VA medical opinion.

    I had one last year. It opened an inferred claim that was actually filed for 12 years ago.

    I fired off a cue claim the same day.

  13. The more weight a person has on them causes the heart to work harder to pump blood through the body. The Hypertension is the pressure in the Blood Vessels when the heart beats and at rest.

    Systolic Pressure above 150 and diastolic above 100 is where it starts to get troublesome.

    Degenerative Joint disease is effected because of the extra weight's effect on weight bearing joints including the Knees, Ankles, Hips, and spine.

  14. Using a lottle logic there, Ask your doc to give you a time frame that it takes someone with OSA to develop hypertension. That should clear up the time frame for you with the correct medical opinion.

    Then ask him the time it takes to develop pulmonatry Hypertension. I hope you havnt developed the second one yet.

  15. Betrayed, (Chief) Keep an eye out for other symptoms from your Nerve Root compression.

    The C spine acts as a Circuit breaker in the body.

    Also remember that nerves dont have to show compression. The Neural foramen sometimes narrows and causes problems also.
