  1. Betrayed, I am Service connected for Carpal Tunnel from a Herniated disk at C6.

    We have the exact same condition.

    The nerve root compression is most likely the cause of the carpal tunnel.

    Do you have a copy of the MRI.

    My EMG said the same thing. The bottom line is you have proof of a nerve root compression. If it has been ongoing for say 6 months or longer, It is most likely the damage is permanent and irreversable.

  2. I have seen Cspine filed secondary to Lumbar spine for Arthritis. It would be a new claim.

    Remember, Nerve groups are rated separately when associated with Ratings of the spine.

    Pulmonary innervation is at C3 with accessory nerves at C4/C5. The Phrenic Nerve.

    The symptoms of this are an elevated diaphragm on a chest xray, wiith paralysis under flouroscope ( Sniff Test)

  3. Betrayed, ask for the Hypertensionto be rated as a seperate disability as it most likely caused your heart disease. Under that criteria for heart disease, Hypertension is to be rated separatly.

    Just get a doc to write an opinion about your HTN.

    I have had several family members who suffered from nephritis. One of the major symptoms is a person gets irritable at the snap of a finger.People also have severe episodes of elevated blood pressure. many patients suffer strokes from this disease.

  4. They will use VA math and only back up and pay an additional 40 percent. Your total rating is 80 and you were already paid 40 so that leaves 40.

    Hope this helps.

    You may want to file for IU if you are unemployable.

  5. I served during an era when we had clost to 600 ships in the Navy. That was the glory days. Our Boats chased Russian Subs all over the Pacific.

    Then the wall fell, The Boats were cut in two, The Tender is in 10,0000 feet of water off of the North Carolina Coast.

    I guess you can say I am a Cold War Vet.

    If I could turn the clock back I would do it again.

  6. Osteoarthritis link to Carpal tunnel Syndrome can be linked to Arthritis of the Cervical Spine at C5 C6. The Ulnar and Median Nerve originate from that location and if an osepyhte or bone spur compresses either nerve it is carpal tunnel a form of radiculopathy.. If the compression goes on for a period of say 6 months or longer then it may be irreversable.

    That is what service connected me for Carpal tunnel.

  7. AB2WK, this post is a good reference post for Hadit.

    Keep us informed as to the results of your C@P exam when you get a copy. I have a question, did the Doctor have a copy of the Rating criteria on hand, I know some Examiners and a lot of them do.

    Contrary to differential postings, VA doctors do carry more weight than suggested. It depends on how they write up the Examination.

    I would like to follow this thread for It enables us to see the workings of Rating officials and Doctor opinions.

    In retrospect, I wonder how many rating officials go against a MD on a favorable opinion.

    Then how many rating officials go against a MD when delivering an unfavorable opinion. I am willing to bet that the unfavorable opinions meet alomost 0 resistance. It should be about even but I would like to see the numbers.

  8. The RO's rely a lot ont he C@P examiners. If they do their work and read the entire record then the Rating Official usually abides by what the Doc says. It is then their job to apply the Examination to the level of disability according to the schedule for rating disabilities. The Doc said 70 percent and based on the fact you are unemployable you may get IU and be paid at the 100 percent rate.

    Now if you have'nt completed the IU form, you need to go ahead and do it to stay ahead of the game.Let me know and I will post the form in PDF in a reply if you need one.

  9. There is a possibility but you have to consider the VCAA of 2000.

    It was a vets responsibiliy to ensure the va had the records even in the governments posession prior to the VCAA.

    You can also look in the the effective date criteria of 3.4, recipt of service department records.

    I am with you on the misquotes, same thing happened to me. ( I also filed cue claim)

  10. Charlese, does your husband have any thing that could be secondary to the Knee. I have seen Awards secondary to the knees because the person has an abnormal gait and strain on another part of the body. You have to have an MD to state that of course. Now for HTN and DMII, Did he have HTN in service or within 1 year after separation. If so was the readings mainly 160 top or 100 bottom? Which was diagnosed first, DMII or HTN. Was he exposed to AO?

    I apologize for asking so many questions but it is in order to better undserstand.
