  1. My appeal has finally made it back to a VLJ after almost a 2 year wait for a remand. How long until I receive a decision back? Also, I requested an in-person hearing and have not received any notice to appear. When does the hearing suppose to take place during the appeal process? Can a appeal be decided in your favor without one? Thanks for any help provided.

  2. In my sc award letter that I got during the appeal process, It stated that I initially sought treatment 3/11. I filed my claim 4/10. Guess what retro date they gave me? Effective date nod is a year old and still at RO. The whole thing is a numbers game. Incompetence or being done purposefully?

  3. People are not doings these illicit things on their own. It's a governmental system that is run like a for profit business and we are getting the worse of both worlds. It's too easy for them to munipulate and adjust their numbers to benefit themselves for bonuses etc. Waiting times are ridiculous. They don't want to fix whats been working for them all this time. I'm not asking for perfection. I wonder if government politicians were treated like military veterans, how long would that last?

  4. An excerpt of sc award letter:

    VAMC treatment records show you sought initial treatment 3/11, and that you underwent a mental health screening with reported trauma exposure when serving in Iraq. Although you met some criteria consistent with PTSD (i.E PTSD screening was positive),the examiner said your symptomatology is more indicative of major depressive disorder. Review of subsequent mental health documents showed continued treatment for anxiety and depressive disorder.

    In support of your claim, you underwent a VA examination 4/11. Upon completion of the evaluation, the examiner concluded that PTSD was not found.

    In support of your appeal, we requested and you underwent a second VA examination. Per VA examination concluded on 6/14, a diagnosis for PTSD is confirmed. You were last seen 3/14 for med management. He goes on to state you have described symptoms consistent with PTSD throughout VA treatment records despite the primary diagnosis being depressive disorder. I initially sought treatment when I originally filed my claim 4/10. I didn't receive evaluation and treatment until a year after filing initial claim.

    I filed nod 9/2011. I rec. the appealed decision granting me sc for ptsd only 7/2014. Eben movement for remaining portion of appealed claim (SA) was: vso to vlj then back to vso. Last movement was 1/2015. Hopefully went back for more development to connect my sa to my sc ptsd and not denial. If denial, wouldn't they have denied it in the same decision granting sc ptsd? Mainly me and some help from a vso rep. are steering the claim boat. I'm gonna call bva and see what is going on. Thanks for the help. Hurrying up and waiting.

  7. To Buck, my initial claim was for Ptsd and SA. I went to c&p's for ptsd and sa. Did sleep study and dx with OSA. All of my MO's for ptsd and sa are from VA doctors. That claim for ptsd and sa were denied in same decision packet. They under dx my ptsd and I had no in-service treatment records. My sa also denied for no in-service treatment records. I began my appeal and filed 1 NOD containing both ptsd and sa. Years pass,I won my appeal and rec.blue award letter granting SC for ptsd. That award letter doesn't say anything about sa at all. I do have other separately filed claims that were all denied and are currently in appeals. On Eben, last movement was from vso to vlj then back to vso.

  8. I have a VA dx for SA. I did have C&P for SA. I received the docs report showing I have SA. Award letter only mentions ptsd. I've been checking Eben, remaining claims are in appeals. I filed them together on same claim, but not as a seconday specifically. I have only VA dxs for both. My SA was dx first and denied. My ptsd was miss dx and denied. I received another C&P then awarded from appeal. My VSO rep says she can't help me over the phone. She is really of no use unless we are face to face. It's to far to just go there, need apointment as well.

  9. Hello everyone. I have an appealed claim with 2 issues (ptsd and sleep apnea). I only received a decision for the ptsd portion of the appealed claim, which was decided to be service connected. The decision didn't say anything about the sleep apnea portion. Is it normal to have a claim/appeal that has multiple issues decided separately? Should I expect a denied appeal or what? Thanks for any help.

  10. Today, I recieved (from appeal, original claim filed 4/2010) SC for PTSD 30%. I just talked to my VSO yesterday and news was bad about my appeals and that I need more evidence to support my claims and another 2 - 3 year wait. Still a little shocked about some success. I'm still contending appeals for Sleep Apnea, Migraines and others. Thanks to all my fellow veterans who didn't stop fighting then and now. Please continue the individual battles and don't stop, even when "they" tell you No!
