I had a fall about a month ago which resulted in an ambulance ride to the ER. The bills are starting to come in, one I already paid. I have no other insurance but was reading that the VA should pay for the associated medical bills. Can anyone help me out here with some information? I haven't had a trip to the ER for decades and have not a clue how the process is supposed to work for 100% vets.

Actually it all comes down to Congressional Intent if it isn't spelled out clearly in the authorizing legislation. If an Agency makes a determination in how it will interpret authorizing legislation an individual or entity still has the ability to seek a legal determination outside the Agency.

Update - it took about 6 months but I was ultimately granted Social Security Disability with 7 years until I will be reviewed.

Through the years I have never submitted a request for mileage reimbursement until today. I was reading the write-up and it stated there was a $3 deductible each way but that the deductible may be waived based on the previous year's income or "if you are in receipt of a VA pension". I have no idea what they mean by this? I'm rated at 100% and obviously receive disability pay, but I had never thought of it as a "pension". Any idea what they are talking about?

I've now been waiting 4 months and haven't heard a peep from Social Security or the State Disability Determination people. I wonder what is going on?

I'm a 100% P&T vet and applied for SSD the end of March. My application is still noted as " Disability Determination Pending". I was wondering if anyone else is in Oregon and can let me know how long it took to get an initial decision?

Question, when you have asked the VA to CUE itself regarding an obvious error, was the action noted on ebenefits? I sent the letter and all the supporting documentation to the intake center. I have a return signed receipt so I know it was received prior to a year from the decision. I however can't find any mention of it on ebenefits.

Curious about the VA Medical Center in Oregon and how they deal with disabled Vets needing specialized equipment? I'll be moving shortly and am wondering if they will support my Insulin Pump that I received in Montana. Would appreciate any feedback.

I'm going to head to the medical center records department on Thursday and ask for a copy. Once I have it I'll go to the patient advocate and ask what is going on.

Not trying to be paranoid but I'm wondering why I can't find my treatment notes on blue button. It used to be that you would be forced to wait 3 business days to see your notes but it's been a few weeks for 3 different doctors. Anyone else having this problem?

Yes, I was awarded PN in the decision from 10 months ago. The problem is the date. I beleive they should have awarded back to 1987, then went to 2003 I believe.
Did they show on the Evidence list, the nerve conduction study? Yes, they did reference the nerve conduction study in the C&P notes.

I have it Berta, was smart enough to make a copy in 1995 when I filed my claim for increase (what I can't locate is the PN rating criteria). So I was notified about my recent request for rating on new secondary conditions about 10 months ago. Do I file a NOD on the dates they used and point out the records they didn't consider and ask that they backdate to 1987 (or 1995 at the latest for the PN) and 1995 for the SMC-K award? Do I ask in the NOD form that they CUE themselves on this matter (after I attach the documents and the rationale)?
Additionally I have PN awarded in the current award but they only provide a rating for the peroneal nerve when I have nerve conduction study evidence that the tibial nerve is also affected. As the peroneal and tibial nerve separate at the back of your knee, and I have zero refexes in my ankles and knees, I think they should have rated my feet using the sciatic nerve (in fact that is what the nurse practitioner filled out on the C&P form. Is this a CUE or a NOD or should I fill out the NOD form and ask that they CUE themselves (I would provide the data they didn't consider as an attachment to the document)?

So the issues are that I started claiming peripheral neuropathy in 1987 as you can see by the attached records. I claimed it again in 1995. neither time was it granted. Certainly if award is based on subjective symptoms I should have been awarded all the way back to 1987. In 1995 I have a diagnosis (in the C&P) but it still was not awarded. So, in 2015 I applied again and it was awarded but they only went back to 3/2003.
I also applied for an evaluation of impotence, an K-1 award was given back to 2004 but as you can see I have a diagnosis back to 1995.

Type 1 Diabetes is my primary disability. My claim was for peripheral neuropathy in my feet. I'm looking for the ratings of the "Diseases of the Peripheral Nerves" (8510 - 8540) that were in place in 1987 and 1995. I have the old rating for Diabetes and it states that it inclues associated conditions that don't meet the criteria for their own rating. So that is why I need to read what that criteria included.
The write-up also stated that there was no evidence of peripheral diabetes. In 1987 the person who took a look at my feet said there was no reason to send me to a specialist and dropped it at that, and in 1995 the C&P showed a diagnosis of peripheral neuropathy, but did not rate the condition.
"nocturnal foot pain, physical exam was normal without evidence of peripheral diabetes" But on the C&P it states a diagnosis.
The current M21-1lll_iv_4_SecG , gives a mild rating for "subjective symptoms or diminished sensation " I don't know if this existed in 1987 or 1995. If it did, it's clear they made an error.

My experience has been just the opposite, as soon as I was rated 100% I felt the VA med folks really stepping up their game. I went to the VA dentist office for the first time today, I asked for a referral on Thursday, got a call on Friday and had the initial appointment today. I get my teeth cleaned tomorrow, and 2 cavities filled in March.
It was the same for mental health, referrals for optical, prosthetics, etc.

I received my C-File today on CD Rom. I was able to find within 15 minutes documentation that:
Shows they made a CUE on a 1987 request for rating peripheral neuropathy and I made the same request in 1995 (I found a C&P which stated they agreed that I had peripheral neuropathy). They stated that it was not paid but was taken into consideration for my primary disability rating. I need to find a rating schedule that was in effect in 1987 and in 1995 for diseases of the peripheral nerves (8510 - 8540) and the criteria for establishing mild, moderate, severe.
I have the current criteria but I think I need to make certain I understand the criteria back then.
Any help would be appreciated.

It took about 3 weeks for me to receive the "envelope", and I received a sizable cash payment. I don't know that there is really anything you can do other than wait.

I asked for a copy of my C-File in November of 2014 and never received it. I applied for a rating on secondary conditions in July of 2015 (after getting tired of waiting for it). I received my rating in April of last year and went from 60% to 100%. After noting the effective dates of some of my disabilities I once again contacted the VA in May and asked for the status of my C-File. At that time they had no record of my request so I submitted a FOIA request and have received nothing to date. This may seem like a small deal to some of you but as my 1-year date from notification of my new ratings is quickly approaching I decided to send an email to the new Secretary of Veterans Affairs on February 16th.
- I received an email noting receipt of my email on February 17th.
- Received an email from the person in charge of getting the data on the 21st.
- Received an email today that the CD copy was made and that it was being sent to me directly.
All together a 5 day turnaround!
I was looking for a specific C&P where I was denied for diabetic peripheral neuropathy in 1987. They found the doctor notes so it looks as though I'll be suggesting the VA CUE themselves on this matter as the criteria for rating is:
Degree of Incomplete Paralysis
Description
Mild
subjective symptoms or diminished sensation
Moderate
absence of sensation confirmed by objective findings
Severe
more than sensory findings are demonstrated, such as atrophy, weakness, and diminished reflexes.
I don't know how they could not have rated me as mild back in 1987, I also asked for an evaluation of peripheral neuropathy in 1993 which they denied. If they backdate the condition it will mean considerable backpay as they didn't actually date my neuropathy until 2005 and in the early years I was rated at 20% and didn't receive any benefit for my wife and two kids.
