Yesterday I had a meeting with a DRO for one of my claims pending about 1/2 before the meeting one of the people in charge of the DAV office called me into his office telling me that it was not in my best interest for this metting to take place because it was going to affect my rating and this rater can look into my file I informed him that I requested the meeting because his people told me that this was the next step to take but he continued to say that I requested the meeting so we went back and foward until the point that this a###### made me mad that I decided to not have the meeting after all. Today I realized I made a mistake and should have gone foward with the meeting and not let this indivdual talk me out of it, In my heart I felt that this guy was working for the best interest of the VA and not me. I need advice on this one I am thinking in chaging organizations and try to request another hearing because I know that I cen get this claim s/c. before I left is office he told me that to not put anymore claims in because they can look into my chart so what am I suppossed to do not file secondary claims because of fear of the VA looking into my chart or trying to reduce my rating.

I thought I was never going to hear from you ( just kidding) The only problem I have is how to open my claim stating th cue this is were I was trying to get some help because i have never writting a claim for a cue. Is there anyway you can give me an idea in how to word a cue I just do not want to mess up. Any help is appreciated.
  3. Luvhim these are some of the regs. I was talkinf about. Tell me what you think about them. 1. HR 1291 veterans Education and benefits expansion act of 2001, specially title II no. 6, Congress made it perfectctly clear that FMS and IBS were consedered separate multi-symtom chronic conditions. 2. Public law 107-103 section 202 Giulf War veterans Chronic disabilities expanded the definition of a qualifying chronic disability to include IBS separate from FMS and CFS. 3. The Board of Veterans Appeals has recognized anf applied current federal law(aforementioned)authorizing service-connected for IBS separate from sercive connected FMS as warranted under USCA 1110,1117,1131,5107,(West 2002 & Supp. 2005) and CFR 3.303, 3.310,3.317 ( 2005)
  4. When I had the c/p exam in 2004 the Dr. assessment was FMS and IBSyndrome(forming part of the FMS). Plus I went to see a private doctor that specialized in Gastro. problems and he also diagnosed me with having Irritable Bowl Syndrome. I intented to see him again because my IBS is getting worse. I have a vet friend that gave me some regulations that states that FMS CFS and IBS must be s/c apart when it comes to Gulf war syndrome criterias.
  5. I aggree with them, majority of folks on this site depend on you and others like you that have paved the way so many of us do not get cheated to what we have earned through our sacrifice.
  6. Sorry that you feel like that I guess some folks get offended and others do not. Well I came to you because you are an expert in this field and I need your help and advice on how to write claims and cue's but if you cannot help than I can understand were you are coming from.

  8. Berta Will a Dro take into consideration if you present as evidence a case that was decided at the BVA that is similar to yours.
  9. So I guess I have too file a new claim based on cue by the VA, thanks for letting me know what to do. If I file this claim to get my IBS seperate FMS will they try to reduce my 40% for FMS?
  10. Thanks is that I see alot of terms used on this site and for somebody that is not too familiar with the way VA works I do not want to make a mistake and pay for it later on.
  11. Pete53 I am kind of confuss with this De Novo term. Is the Dro the same person that denied your claim the first time or is it a different person.

  13. I requested a hearing with a DRO to try to get a claim s/c.
  14. I am have a meeting this week face to face with a DRO relating to an appeal case. Any adivce in how to dress, how to communicate, present enough evidence or just enough. need all the adivce I can get for ths one.
  15. Since this case was awarded in 2004 and know I come to relize that they probably made an error can somebody give me an idea on how to open this case. Is it NOD or CUE.

I recieave 71 dollars for my daughter from the VA, when she turns 18 she will still be in HS for which the VA will pay 222, upon graduating she is going to college in which she can use her chapter 35 benefits so far so good. On the other hand social security will continue to give her her check pass 18 as long she is in school. So it is my understanding that if my daughter goes to college she can get her chapter 35 along with her social security check.
  17. I am claiming my daughter as a dependant but when she reaches the age of 18 she will have one year left in HS to graduate, what do I need to do in order to continue to have her as my dependant. I do not want her to use her chapter 35(DEA)benefits until she is ready to go to college. Another ? my family was awarded chapter 35 benefits in 2004, when does my wife benefits end and when do my kids benefits began and end I am alittle bit confuse with all these benefits.
  18. The doctor stated that I had constant symtoms of constipation and diahrrea but according to the 38 cfr 3.317 if you look it up in the va site and tell me what it means to you.
  19. The c/p doctor stated in his assessment Irritable Bowel syndrome forming part of the Fibrom. syndrome
  20. I kind of found out about the regulations and the code for Fibrom. but I cannot find out was is the code for IBS. If anybody knows it can you please give it to me. Should i open my case by stating that the VA made a CUE on the desicion made on (dated)due to the fact ( state regulations). Does that sound like a pretty good opening. Any help or correction will be very hepful.
  21. How can I word a claim since it was s/c in 2004 and the nod period is already expired.
  22. This award was givin on 11/04, how do I write a letter to have my ibs symtom seperated from my fibrom since it was diagnosed ?
  23. No. they added it as a symtom of my Fibrom.
  24. If you are a veteran of the first gulf war and was diagnosed with Fibrom. and IBS on a c/p exam is it true that you can have both of them s/c separate. I was diagnose and s/c for Fibro. but my IBS was included.
