  1. We are 11 years and counting ...4 months is a cakewalk!! :P ...and they took it on pro bono but I still believe alot of the pro bono falls under the Equal Op To Justice Act for them so they bill the gov't anyway................ B)
  2. for awhile I had to keep up on them-so I sent letters thru for different things-maybe now they'll keep in touch with me B)

Berta, Me too hope it goes quick-the lawyers said they wanted to push it thru back to the RO asap since its been 11 years and counting...if I read the remand correctly I believe the diagnosis from the VA doc was what they wanted, because there was a differnce of opinion between the 08 IMO and the 07 CPexam on factor C-he did meet more than 5 of the DSMIV critieria then-which the lawyer stated in his addendum as a rebuttal to the DRO hearing ---and the stressors have been verified according to the 08 SSOC I know to read alot of these, but if you remember they said he was diagnosed with PTSD back in 05'but they failed to verify stressor then-then when they did -they said he had "various psych. diagnoses"after his 07 CP-but yet as you know his SS is for PTSD-and has been since 03'---say a prayer for us!!!!!!!!   7. they also deferred TDIU- until when? I know you've been thru it!

Betty, we turned in the TDIU back in 06'- the thing is they know he hasnt worked since-his NSC pension- and they offset that with his SS anyway-the lawyer wants to go to this one-what can they do there and they probably wont even let them in-but you can be sure I'm going! what do you think with the stressors being verified? and dont forget they admitted PTSD in the SSOC- and then changed it after they verified stressors.   9. According to the buddy statement stressor #1 by another who served with MRvet filed on 4-2-05 on 21-4138 he states"I was a helicopter crew chief in 1968. I was stationed at Danang and Red Beach with the 478th Aviation CO. I traveled north to Camp Evans and beyond during the day, and back to Danang air strip on Red Beach at night. I recall several incidients of rocket and mortar attacks that happened during the time I spent there from April-Oct 1968" --second stressor: April 1968 "the day before PS was shot down and killed in the Ashau Valley we were at base camp at Red Beach, the TET was in full bloom all compounds around the area were hit at once that nite VC infitrated the compound and there was small arms and mortar fire: I was blown from my position and lost track of PS,VC infiltrators were fought off that nite till dawn gunships were deployed -that am i was treated for scrapes and abrasions and released - PS flew off to supply UNK-helicopter took hits in the cockpit and exploded (MRVet and he were friends) Claim filed 1998: The BVA remand states" In a Jan 08 SSOC the RO found that the evidence demonstrated mortar attacks on the veterans base in Danang from April-Oct 1968' and records verified the death of PS who the veteran reported had been a friend- the Board concurs that to this extent these events have been verified, but the other events the veteran claimed to have witnessed during service in Vietnam have not been identified with sufficient specificity to warrant further efforts of verification" (his original stressor was 10 pages) before we realized about who-what-when and where- #2: the Board finds evidence of record that the veteran served at Danang when that base received rocket and mortar attacks and that the left leg injury claimed to have been incurred at that time is consistent with the circumstances of his service . As there is no medical evidence relating a present left leg disorder to active service an additional VA exam is required------ (then they did a VA exam on his leg,last week, it took 12 years) question: so are they even considering the buddy statement stressor #1 or is it being linked into the mortar attacks ? and I believe in the DSM_IV manual"witnessing or learning about the death of another " also applies-? AND WHY DID IT TAKE THEM THREE YEARS TO VERIFY BUDDY STATEMENT :D should it be mentioned to the examiner he is on SS for PTSD since 03' as well as unemployable - the last one didnt even read the c-file or she would have known which VA psych,originally treated him in 01'!! she had to ask me-after they released me from security where she had me put if you read this saga before! CP exam is Wednesday-replies appreciated-Thanks Mrsvet :)

  11. Question: after the BVA remand exams as requested are finished ..then it goes back to the RO to be approved or denied is that correct protocol? or am I missing something Thanks Mrsvet

Heres an update to the saga:MrVet went for his CP leg exam- which I guess because they verified his stressors after 12 years-anywoo-the doctor called the house the next day to tell him he has "arthuritis" in his knee and ankle- and he should have his pc doc-take a look(the same one who thought he had bladder cancer)when we asked him how his leg exam is he said he couldnt comment on that because it is for CP-so do they consider the mid-leg part of the leg? because the knee disorder has already been dropped-and is the ankle considered part of the leg? to us it is but to them I'm not sure of the lingo? Danke Schoen!
  13. First time I met her and told her his symptoms and his medical history-she told me you be quiet i'm the doctor-so I replied how old is he? no answer.......... <_<

Mrvet had his left leg CP exam which we believe went ok-the examiner was very thorough-perhaps we are thinking is there a difference in what could be a exam for a rating?(claim is 12 years old next week) the examiner said he was there to rate Mrvet --also the past CP PTSD exams were scheduled for a least 4 hours-this one is 60 mins, as was the leg exam-for some reason the attys. wish to attend the PTSD/exam next week-never heard of that before/could this finally be over?- have they finally realized everything has been proven? and maybe they finally realize he's been disabled due to PTSD with SS and hasnt been able to work since 01'--which didnt seem to surface much during the appeals processes and we had to keep reminding them of various pieces of evidence that was not being acknowledged over these 12 long years-and 4 or 5 file cabinets to keep track of it all, and by the way did any of you who were successful in your claims, have a BURN THE FILES PARTY??? <_< I think we could wallpaper the entire apt. with them!!

So an update to the whole saga-Primary Care new doc that MRvet was assigned to(other one retired)read that he had bladder cancer from a Scan and scared the crap out of us..fortunately we had outsourced when you could (they no longer will let him) the private urologist said he had a long overdue TURP needed-(which when they attempted it at the VAMC the equipment broke during the procedure and neddless to say he couldnt pee in peace for along time after that) then the VAMC had no urologists for months after that-so our Congressman said we could go private(the urologist he privately had quitworking for the VA and had a private practice so he felt comfortable with him and trusted him)he successfully had the TURP with private uro. it wasnt cancer but a long overdue care - we thank our stars because the VAMC-would have removed his bladder unnecessarily --...ps. now he pees like a baby does :P
  16. In the SSOC 05the VA admits finding PTSD then said" in absence of verifiable stressor which would permit finding of service connection" so it was denied. Then 2 years later the SSOC 07they verified the stressors which they had way before in 04' the first SSOC (but just didnt bother to verify them-then changed their diagnosis from PTSD to"various psychiatic diagnoses"after they verified the stressors. They also never mention in the BVA remand that MRvet is disabled due to PTSD from social security since 03' and reason-being he has NSC pension which is offset with his SS-but somehow that has no substance-he has a doctors diagnosis from 1 month after returning from Nam, with anxiety on which he was prescribed librium various times in the 70's-they really are disregarding his positive IMO's from all 3 private diagnoses of PTSD-but yet they offset his money every month-so I guess PTSD in Social Security Law is different than PTSD in VA Speak! and that was an addendum that was submitted after the DRO hearing by our atttorney before it even went to the BVA hearing -that was in fact an inconclusive PTSD exam because as he said he met all critieria for PTSDthat was required according to the DSM_IV and not all 7 were necessary-back then I wanted a new exam, they advised no, and she is the same one who had me detained by security the whole time -I told her I was allowed to be there, and off I went -when she was done with him -she let me back escorted by security down the hallway to go get him-I guess I was considered a terrorist??????????????for protecting my husband whom I've been with 30 years and counting......hope that helps

Congratulations on your successes in the up-hill challenges and obstacles, and rabbit trails, you have been through with the VA. Like many of us, you and Mrvet have helped pay for a great number of VA employees' 401K plans. Remand, remand, remand. It's a never ending circle sometimes. I really don't see why you are concerned about an MMPI. Does the VA claim that your Hubby has a personality disorder, as well as PTSD? That has been pulled on many of our younger new disabled and wounded vets. I have never heard about a MMPI being used when determining PTSD. Very odd???
  18. In the past he has had them each time before the examiner spoke with him- and then they reported "overexaggerated symptoms"
  19. If you recall this saga last time I went to be present the b*****h examiner had me detained by security-maybe thats why the attorney wants to go this time :D
  20. I am not concerned but I find it odd in the last CP exam the examiner reported overexaggerated symptons on the MMPI - and so did the one he did in 02'-he cannot concentrate or even work a computer for that fact-and they used it against him-he is a Vietnam Veteran-
