Broncovet, I'm not very upset, I just always am waiting for something to be screwed up again, or missing and try to stay one step ahead of them, because this whole process makes yo u bitter and suspicious when it goes on and on over the sameol' crap and you submit and resubmit and fax and mail --and I do believe it is at the end/with confirmed stressors-3 postive IMO-a solid cp diagnosis finally- with no loopholes in it-they were cued by my first POA on "duty to assist "in 5 issues-it took 7 yrs to verify stressors or even recognize them-his first diagnosis was in 70 when they called it "anxiety" and gave him librium- if you knew the whole claim u would know why I feel this way-and of course with it all ending I'll probably burst into tears-but day by day Mrvet gets older and sicker-and this will all be for naught to not have him by my side to burst into tears with, the lawyers have it now and they feel very positive....
  2. Great post, hope you had thatpeaceful cup of coffee!---So I am guessing that is why the lawyers mailed and faxed everything the remand called for--so they wouldnt miss nothing as they said to me--now I'm thinking I'll keep them!!
  3. So is it wise to prepare to appeal again while you are in remand?or do they just need to connect the dots? The situation here is all of our appeals were timely since 1998--4037 days and counting....since first NOD...I believe there is CUE all over this-but hired a llawyer over 2 years ago..he is my thirdPOA and I'm letting them get headaches now...Thanks for your reply

Thanks for your response-as you said I did right away get copies of the "equipment malfunction "(while they were doing it)/ he was MIA for about 6 hours--was supossed to be 1 hour surgery or so- my daughter and I sure did panic!! he has had 11 cystos since 1999(have copies of them too)-and finally when we farmed out to private urologist - they did it right and he can pee again without crying or p-ing blood--and the garlic ,good idea, as I make what you call"natures penicillin" 24 cloves of garlic and 1/2 jar honey-just press on the garlic till it splits , pour in rest of honey,leave in the sunlight for 2 weeks-then it becomes opaqueish and fill with honey-2 tbls. a day-really does fight colds..etc..I remember when my kids were little, everyday they washed it down with carrot juice-and then my DR> penalized me when (my kid stepped on a nail and needed tetnaus)I hadnt gone there for 6 years!! and charged me as a new patient.!..PS our lawyer is med malpractice too-right now we are wating on remand for a very long PTSD claim11 yrs....and counting..Thanks will keep you posted ...MrsVet

Berta, You are a mover and a shaker, and will get to the bottom of it-you give me strength, it is just a nice day when there isnt the thought of these claims on our minds-today I took my grandaughter to the park for 3 hours and forgot about it ...do the people on the otherside realize how this consumes us? trying to prove what already has been done and then you gotta do it over and over.........anyhoo-I wish you a nice day when the sun is shining and the air is crisp,enjoy your coffee and listen....to the quiet
  7. Just curious if anyone ever got a Staph infection from a surgery-and if so does it show up unexpectedly at any time? MrVet has an open sore by groin that starts out looking like a bite --it has like 4 pinpoints on it and then goes into a fullblown oozing sore--always either above or below where it first broke out-it showed up after a cysto-and now also always has hives and welts-he did have a Turp when equip. malfunctioned-and it cost him alot of years being unable to p w/out pain-finally farmed out last year and had a succesful turp--if you remember the VA said he had cancer -but he didnt and they would have removed his bladder.......anyone with similar-they dont know whats wrong with him-could this be AO many years later???

Way to go! hope I will be blogging that sometime soon-were you in a remand for 3 years?-since the first NOD I filed its been 4036 days-because in 98 had some bad advice and too many open issues- then came hadit.com and these great knowledgeable folks here..but we are still waiting been a year since the remand......

But that wouldnt be the 20% of retro award would it-because if I've done most of this paperwork and research(they even commented how I have superb recordkeeping) -I dont wanna share that-because they went to 2 hearings-which I felt the DRO and the BVA hearings were pretty much the same --then it got remanded back to the RO warranting another CP exam..still waiting expeditiously my butt....

  11. My question is: if the RO missed something to begin with(like crucial evidence to the claim) WHY DOES THE BVA REMAND IT BACK THERE TO BE DECIDED- ie: MrVet had a conflicting 2ndCP to IMO exam and 3rd CP agreed with the 3 IMos which were done over a 6 year period?
  12. If I dont keep on them I feel they just sit back and keep telling me "let us worry for you now" that was 3 years ago.....
  13. In the past years one attorney I contacted said they couldnt help me until the BVA level sent a remand or denial-my present one I brought this up to them and they really had no answer and I still dont know-

I do not feel mine are doing anything to speed up the final process, even though I signed a contract-I am ready to let them go because I've done everything they went to DRO and BVA hearing - and I dont feel that warrants all the $ for them-

Hoppy, Same here with Mrvets claim -- after the remand -it took them a year to schedule a CP exam because the IMO(favorable) and the VA CP differentiated in the PTSD diagnosis-then they put it in a "special handing place "for 150 days(whever that was) they said they couldnt schedule anything until the 150 period expried-then it had to wait another 120 days before anexam could be scheduled-the remand warrented the new CP exam to find a PTSD diagnosis of 50 % or greater- because originally it said based upon the evidence of record the regional office would permit finding of service-connection, because of the differnce of opinions between the IMO's and the VA- it stalled it for 3yearstotal--now the AUG CP was favorable-and it was supoosed to be afforded "expeditious treatment"the folder didnt get back to the DRO till Oct 1--the whole month of Sept went by-it is now Nov./and they never recognized he has been on SS for PTSD-and a NSC pension since 03' because he can't work and we had no income-but it doesnt seem to matter-/when I called they told me it is on the DRO desk-so I put some heat on the attys. to speed this up-this is the only diagnosis we needed to settle the claim-they already verified the stressors/ and the SS IMO and 3 private IMO-and 3 VA exams !!! We have been stuck in the wheel for 12 years--Take Care MrsVet

  19. WAS JUST THINKING -HAVENT HEARD MUCH LATELY ABOUT BENEFIT OF THE DOUBT -SEEMS LIKE IT VANISHED-- DOES IT STILL STAND IN APPEALS PROCESS- HAVENT READ THEM LATELY :)

I spoke with someone the other day who is 100%since last year and fought claim since 03' he was in NAM and a POW--he got a very large retro-they went a way back to 63 I believe- he said they called him to tell him of award--any body else?? (he went through a Senator to win his claim-he didnt have a VSO-)
  21. Mr vets claim is the same pattern he also has been on SSdi for PTSD since 03 and they still overlooked that over and over .......and I kept sending that over and over..they didnt list it in the evidence the first time at all..same thing here all these years
