  1. I've written about this before, but I think I might be confused about something...

    My husband had toe surgery(non sc), and the podiatrist screwed up the toe. He is still having severe pain, which he had before the surgery(had to go to red team and get a shot today) and now the toe joint is fused together and will not bend. His podiatrist will not have anything to do with him and his primary care dr. sent him to PT which he completed to no avail and tomorrow he sees a neorologist. Anyway, he filed an 1151 claim which was denied I beleive they said it was not due to his sc condition. Well, no it wasn't, but don't you still file an 1151 for this or is there something else? His so has filed a nod or whatever you file but we have not heard anything else. Any ideas would be appreciated. And what about a tort?

    Also, if you have retirement established in a previous company that you worked, can you take it in lump some if you become disabled without penalty? Would this be offset too?

    Is there any certain number of years worked as a a federal employee to take the "Fed Disability retirement under Fers"? Like could you have just worked 1 yr for example and get the "Fed Disability retirement under Fers"? Also, is there a link to this about this and SSDI percentage offset?

  4. Thanks everyone for the information.

    My husband is scheduled for a C&P in a couple of weeks. He already recieves 10% for DD(for many yrs)and put in for an increase. His NP (which he saw last week) said she knew the examiner and told him to take in some printouts about his heart disease to her as well. Don't know what this would have to do with anything, but that's what she told him to do. I guess her insight into that was the heart disease makes the depression worse. She also said she would leave the DD and add MDD(which I guess she did) to his record.

    Does the GAF mean anything? I read in a different topic where people with the same GAF had different ratings. Is the rating entirly up to the RO?

    My husband just had an appt. friday with mental health through the VA and the person he sees told him about the scheduled C&P before he was notified in the mail. She also told him that she knew the dr. doing the exam and had known her for 20 yrs. and she told him to take some printed matierial (that he had given her) and give it to the dr. at the C&P. Have you ever heard of this procedure?

    If someone has a letter that they have written pertaining to suicide thoughts, should this be given to the shrink and is so, what would they do with it? Would they put it in your file or what? Also, is you have a C&P for a mental increase, should this be taken to the exam? Oh, the letter is about 1 1/2 yrs old, would that matter?

    If your putting in a claim for an increase for sc condition and you want to file something secondary, should you file for the increase first and wait for that to finish before filing the secondary or file all of it at the same time?

    He was not going to the VA at this time. He had quit going around 1984. I don't know why he quit going

    but he was going for sc 10% depression.

    He contacted the VA in 2004 to get a letter for employment, at that time they said they had "lost him"

    and sent the letter for 10 points preference for employment.

    During these yrs., He was seeing a primary care dr. on the outside and had his heart attack in 1996.

    He has seen the same cardiologist since 1996. He also was not being treated at all for depression during all these yrs. Again, I don't know why, but he really should have been. Anyway, he is now back in the VA and his primary dr. there thinks she is not only med.dr. but cardiologist and shrink, however she did finally send him to a real shrink per his request more than once to her. The VA pyschologist told him the depression caused heart disease, but so far has not put any of this in his records. He is to see her next week and he wants her to put that in his records.

    Does anyone know how long you can have diabetes before it surfaces as full blown diabetes?

    Reason....My husband had a heart attack in 1996 at the age of 39. He had to have a quadruple by-pass. At that time he was not dianosed with diabetes.

    Fast forward to now...His cardiologist(which he has had from the beginning) says he thinks his heart disease was due to Diabetes.

  10. Sorry for beating the dead horse, but I still don't quite understand.

    The shrink for example...can be a board certified pychiatrist I assume outside the VA correct?

    Also, the word costly has came in a couple of responses...if you have medical insurance, would it

    cover an IMO or not? Would this be like a regular dr. visit or is there something else in searching

    for an IMO dr.?

    His VA dr. is of no help at all. She has stated to him in the past that she thinks everyone is trying to

    get something for nothing(I son't remember exact wording but very close to that). She looks fresh

    out of med school and probably just sticking around until her time is up there. He wants to switch drs.

    after his next app. with her which is 5/18,

    Anyway, is there any thing special that the dr. needs to write? Any form or something like that to go by

  12. I need help one more time. I'm sure this will not be the last time but I know what IMO stands for

    but, how do who go about getting one. Like if you need an opinion for a knee or toe problem do you

    go to an Orthopedic dr. or if you need heart disease to depression do you go to Pych. or Heart dr.?

  13. Okay, my husband finally got someone with the AL that knew what he was talking about.

    He was able to pull up his records right then and submitted for an increase. He did however ask about

    the so called rep that he met at McDonald's(which is where the guy wanted to meet him) anyway

  14. Thanks everyone for your information. My husband is trying to find a knew VSO. The current one is

    suppose to be the AL, however he met with the guy and he was only interested in telling him about

    the Church he attends and wanting him to go there. He contacted the DAV and they didn't even want

    to talk to him because he had the AL. So where to go from here?

    Vicki- to answer your question "Has he received psychological evaluations periodically from the VA or a private psychiatrist during the last 26 years?"

    He was seen by the VA yrs ago and some how he quit going(don't know why) and when he called them

    about 2 yrs ago, they said they had "lost him." Anyway, he is going there again. He did not see

    anyone for a number of yrs.(he needed to in my opnion), so he was on no medication either. He since

    that time had a heart attack at age 39 with a quadruple by-pass, and also diabetes. There is several

    reference material online linking heart disease to depression and his Phycologist said there is a link.

    Some of the material is VA drs. stating this link. I did find a C&P from 26 yrs ago in his records which

    I'm sure was different back then than what it is today, however on the top it said C&P 53. I don't know

    what this means. Maybe nothing. Also on one page of his records(he is 10%) the Phychiatrist wrote

    "disability 30-50%. Any idea why he would write this?

    I guess he did or someone did file a claim because he is currently at 10% and has been for the last

    26yrs. However, upon looking through his records this morning and seeing some of the terms used

    they fall under the 70% criteria according to " General Rating Formula for Mental Disorders". He

    was very young at the time and I really don't even know if he had any kind of representation helping

    So the VA did rate but very low. So would there be anything that could be done about that now?
