So if you win the FTCA but not the 1151, they can not offset this by your disability comp either can they?
If this is the case, it would be better for a win under FTCA rather than 1151.

Is a FTCA the same as TORT?
IF so.....Carlie,
IF you won the FTCA but not the 1151 how do they get the money back? I thought that they would keep the 1151 money until the amount won was "paid back". I probably have this ALL confused.

Should you always file a FTCA claim if you file an 1151 claim? Also, if you won an 1151 claim but was awarded 0%, would there be a point to filing a FTCA claim? How would they re-coup there money if you had a 0%?

Where could this be found "John-it would not hurt to copy the NVLSP statement on atherosclerosis from the VBM and send that with you claim and even give it to the IMO doc."

I have two questions reguarding an IMO. I know this one has been here before, but for some reason, the search feature does not work for me.
What all needs to be included and the format?
And I kinda thought of this and thought I would ask it for other opions....
Since most drs. are too busy just about to spend time needed on patients, I was wondering if the IMO could be written by ones self, and the dr could read over it and sign off on it. Would this be the same thing as the dr. sitting down and writing it him or herself?

Here's another twist in this situation....
He went and picked up his records from that visit and the dr. wrote that they talked about things that they didn't even talk about. He called to find out when his next app. was with this dr. and was told he no longer worked at the VA. That sounds like a good thing. Anyway, is there something you can do to have your records changed to reflect that this dr. did not talk about the things he claimed they talked about or is it just too bad for the patient?

Thanks for your response. He goes to the VA clinic for this, and they had a NP who was contract. The VA decided to make this a permanant position, so they hired a Phychiatrist and did away with the NP. So I guess this will be his new dr. The NP he felt comfortable with, and she did talk to him and spent as much time as he needed. This new dr. was just in and out and that was it. He may have to see if they will change him to another facility.

Hi,
My husband saw a new shrink last week and he wasn't in there 5 minutes. This was his first app. with this dr. and the dr. asked if he thought his meds were working and said okay and said he would see him in 3 months. He didn't ask him about any problems that he might have or anything. Is this normal? When he was seeing a NP, she would spend as much time as he needed and he really liked her. He's not to sure about this new guy.

Does anyone know if there is a training letter for heart disease or coronary artery disease? I have seen one for diabetes, but need one the heart disease.

Thanks Berta. I looked at the picture of the foot wrong. The metatarsal bones are in the top of the foot. I thought it was the bottom joint of the toe.

Thanks everyone for your response. He got called today from the Pod. Clinic to come there and they ordered his shoes and gave him socks as well.
They said that since it had been over a year, that was why he had to go back to the clinic. If he calls next year before the 1 year is up, all they'll have to do is put it in the system and he want have to see anyone.

As some of you know my husband filed 1151 claim for toe surgery and won it. They awared 0% for hammer toe however, we fell like even though- yes he does now have a hammer toe from the surgery, the toe also does not bend at the middle joint, so could this fall under this category....
5283 Tarsal, or metatarsal bones, malunion of, or nonunion of:
Severe........................................................ 30
Moderately severe............................................. 20
Moderate...................................................... 10
Note: With actual loss of use of the foot, rate 40 percent.
If so, can we fight the current decision to try to have it changed to the above category?

Hi,
Does anyone know how to request diabetic shoes? It's been over a year since my husband got a pair of SAS shoes from the VA for his diabetes. He told his knew primary care dr., and she said he would have to go to podiatry clinic. He called the TAP line, and left message for the podiatrists that got him the last pair, and they called back and said he needed to talk to his primary care dr.
I think we're in a continous loop!

Such as cardiovascular, mental health and so forth, and if so, where are they located?

One more question....can you request a copy of (I think it's called the blue sheet) from your SO?
My husband got an increase for sc condition in May and 0% (1151 claim) for his toe in August, and has heard nothing from his SO. Shouldn't he at least acknowledge whether the increase is ageeable or the o% is acceptable? My husband e-mailed the guy a while back but has not heard anything from him. Of course, we do realize he is busy helping others as well, but at I'll get back to you or something...

Thanks everyone for your response. I don't know what he's going to do, but he does work there too. He actually passes this woman in the hall occasoinally, so you think she'd be a little nicer. Would it do any good to report a dr. if it's your word against theirs?

Hi All,
My husband wanted to me to write in to let you know that he's HADIT! His primary dr. is out and hopefully a better is in. He has put in for a new primary care dr. because of the ongoing problems with the current one. Her lastest was this.....Dr. SOand SO called me this afternoon. Told me she could not prescribe Tramadol because it would conflict with my depression medicine. ( I wonder if it was Welbutrin or that %&%#$ she put me on) I asked for anything else. She told me to take Ibuprofin and that I had an appointment with the pain clinic. I asked, ?So, I guess I?ll just have to stay in pain until then??
After that, I called the TAP again, and canceled my N0v 20 appointment with Singh. They asked for a reason, I told them I was not going to see THAT Dr. again!
Let the folks at HADIT.COM know about this if you will. Because, I have HADIT!
This dr. has been nothing but a pain in the you know what...The first visit, she told him "she was tired of all the people coming there for government handouts."
When he needed her to write that his toe would bend before the screwed up surgery...she would not do it and yelled at him in the process....

"I get a disability retirement pension from the federal government since I was a civil servant and all of it is taxable. Not to mention the fact that my federal pension is offset by my SSDI. Before deductions it amounts to about 2000 bucks a month from both my pension and SSDI. What a joke for 20 years of work. "
Can you explain how the federal disability works with ss? I know there's some formular to it, but I just can't seem to understand it.
