So If I am already rated 100% by The SSD there is no point in filing for this, correct.

I need an explanation of TDIU, I've done a search and can't find what I need. What does TDIU entail. How does it work, how do
you file for TDIU, how does it affect when rated 100%. I am confused again.

Don't want to create a problem here, But I have gotten to the point of not trusting any VSo's, as many times as I have submitted my claim and it's been denied. I finally found hadit and got the help I needed. The VSO's never have helped the
way they were supposed to. I finally figured out that these folks here are pretty darn smart and they will help.

I am definitely revocating my POA. I just think something should be done when a person lies for no reason.I am gullible all she had to do is say I will go talk to them and I would have waited for this supposed fix, that is never coming. However I have hadit and know something isn't right.
How many others don't know about hadit or know what she did is wrong.
One way to fix this type of behavior is to have them licensed and if they don't follow the rules, they can lose thier livelyhoods, just like, doctors, nurses, insurance agents, real estate agents etc.
I gather there is really nothing anyone can do and this behavior is normal for vet reps or should I say acceptable behavior.
I will file a complint letter to the headquarters but I am sure nothing will occur. To protect myself incase she says or does something with the person working my case at the regional office, I need to document what occurred.
I am truly appauled.

If a person is rated at 100% disability by SSD and can not work, does the VA consider this when rating a disabled vet. Are they automatically considered unemployable by the VA?

Hey Bernie,
The folks here can help you, if you ask questions/ If the VA does not acknowledege PTSD, you may have not provided them with the "stressors" incurred in the service. You always have to provide them with "evidence" of those stressors. If you can hang in there and frequent Hadit we should be able to help you figure out what's up and maybe guide you thru the mess.

Bear in mind I am only trying to help. I just had a meeting with my VSO and he gave me a sheet that has a pretty good (I guess) definiton of nexus:Medical Nexus Opinion Letter\\
Cite service medical records,any rating decisions from the VA and/or statements from individuals.
AND
The VA may consider your issue if you send in scientific or medical evidence showing that your claimed condition is medically associated with service.
If your doctor has expressed an opinion regarding the relationship of your claimed condition, send the VA that opinion, the reasons and basis for that opinion, and the clinical treatment records.
In addition, the doctor should provide literature that supports the opinion. literature my consist of scientific or medical journal articles,etc,that support the doctors opinion of your currently diagnosed condition.
The doctor should use the following wording "at least as likely as not" but VA will usually also accept "probable", "likely", more than 50% certain, etc.; in other words, phrases that throw the balance more in favor of the claimant.
IN THE CASE OF A SECONDARY CONDTION:
A secondary condition is a direct result of the primary condition. This is important because mant doctors like to include terms such as "contributed to", "may have", or "possibly influenced" or similar phrases in their nexus statements: these thypes of statements are not sufficient to satisfy the "proximately due to" part of the regulation "is possible", "could have", "may have", etc. As with any nexus statement, the best wording is " at least as likely as not" but VA will usually also accept "probable", "likely", "more than 50% certain", etc; in other words , phrases that throw the balance in favor of the claimant.

I did, Shows right in my records,they did deny. I have had treatment since 1997 for depression, Both civilian, and, MHC/VAH vet centersince 2002. tried before by going to DAV first I went 3 more times to DAV and filed the same claim. I was told I had no rights to benefits by Navy. So I thouhgt I would have to go thru the DAVfirst. It was denied evrytime. Says right in my discharge papers,It say's "precipitating stress: routine military service". Remember that it is not claimed as PTSD. Just depression.

RSGMaybe you should hire a lawyer. If you filed one month after discharge and were denied you might have a CUE if the decision was final. 1969 has been a long time ago. When you go to file a claim now after almost 40 years with no treatment for depression in the years since discharge I don't see how you can do it unless you can show that you should have gotten it to begin with back in 1969. People with PTSD are able to get SC'ed 40 years later without treatment records because of the nature of PTSD. You better have some combat awards and a current diagnosis of PTSD. The longer away from the event and service you get the harder it is to win a claim.

RSGThat letter sound pretty good to me. You were hospitalized in the service. You have medidal records to prove it. Did you continue to get medical treatment for depression when you got out until the present time? Are you getting medical treatment at the VA now? If you can get a VA doctor to say that he believes your depression started in the service that would help. How long ago did you get out, and how long was it before you filed the claim?

I dont know what the SSOC fully states so I dont know why.

SSOC I received from AMC.
The fact it was a in-service Nexus has to be proven. I guess I need to know what I need to provide
a nexus. I have provided my files to Dr. with descriptions of the "events". I am sorry, sometimes I just don't understand unless it's explained in detail what I need to do this. How do I prove the depression
started in the service. There is no valid evidence that The AMC has that it pre-existed. I was never depressed as a child. I am really at a loss here. All the Amc wants now is a letter in my own words, posted this letter already. What do they want from me. How is my letter going to affect a decision.
Do i need to quote CFR's that Apply to my claim in the letter, do i need to have a CfR that shows that anything that prior to enlistment, presumtive mental and physical well bieng, and can not be used in this decision. Will my c file show what they are basing this decision on, or will that be removed from my c-file, cause they think it will be a trigger? Then I can't answer or rebutt anything they say.
If you want to look the first SSOC letter from AMC I will scan it and let you (ONLY) look at it. If that will help. I am just really confused now.

I explained nexus in a prior post.
This letter would fully support that a nexus factor caused you to have depression.
The fact it was a in-service Nexus has to be proven.
If the VA did not provide a full medical rationale to reject this letter they should have stated why in the SSOC.
Any strong IMO in the world is not the same thing as a proven nexus.
It is just a statement from a professional that opines that -something in their opinion -happened that could have caused the disability.
The 'something happened ' part is up to us to provide- with corroborating evidence.
Example :
A Thailand vet had an AO presumptive disability.
DOD has never acknowledged we used AO in Thailand.
The vet gave detailed account of his contact with the Hayes Dispenser.
No vet would know that stuff without knowing what the Hayes was used for-
(AO spraying)
The Vet also got buddy statement from his CO or some Mil authority who served over his unit-that fully confirmed they sprayed AO on th perimeter with the Hayes and that this veteran was exposed to AO in Thailand.
The vet was the first Thailand vet to win AO claim.
I posted the claim here long ago.
The veteran proved his Nexus-the actual link, etiology, cause, reason for him to have an AO disability.
Are you repped by the DAV in Boise? And what advise are they giving to you as to this SSOC?

what i was referring to was the fact that the Navy went in to site 12 and took tonages of waste
in site 12 out. Now they are going back in to remove more. In 2007 i just read this.

I understand ad have seen his dd214 and an orders history,medals awarded. She is on the up and up. I've helped her with her
money so I know thats real too. I just saw her military ID card he's for real.I have never seen any of those payments. Just thought I might be able to help somehow.

I sure didnt mean that widows are mistrustful of veterans-or should be-not the case at all-
as a matter of fact the last two "widows" I dealt with were awful- one was a wannabee I reported to the VA (she was perpetrating a VA scam) and the other one married a 100% vet on his death bed in a Hospital-
a few months before he died and the VA questioned the length of their marriage-with good cause-
We all look real cute to others when they find our we get VA benefits.

This is not to mention the fact that a great majority of tha barracks where located right on top of the old ammo bunkers. this is referred to as Site 12. It is now fenced off. The Navy is going back into this specific area to remove a large tonage of materials from this area. even after the first, There is more????????

BRAC makes recommendations to congress as to which bases should be closed and remain open. It, as I understand, was created by congress to help isolate the decison process from very strong political considerations. (HaH!) Originally, Congress was supposedly to vote up or down on the recommendations as a whole. The community I live in has had several major "scares" involving BRAC. It seems that the largest employeer in Mid Georgia is the Robins AFB.Anyway, the information about contamination with Dioxin at Treasure Island Navy Base is of serious concern. The majority of Vietnam era USN sailors sent overseas to the Far East, 7th Fleet, and Vietnam were routed via Treasure Island. A large number of those returning from Vietnam and the Far East were also outprocessed for Discharge/Seperation at Treasure Island. Many of the sailors may have attended at least the Fire Fighting School, one of the Dioxin contaminated sites at T.I.
This information may also have some effect on the "Blue Water" claims.

I am sorry to bother the group with this, but I really need to help this lady get her husbands benefits,
He was exposed to agent orange, died from it's complications. He was never able to get any benefits from
VA for this, because he became i'll and died. I need to try to help this lady. She only has an 8th grade
education. She has gone to DAV/VSO, and from what I have been able to determine all the flood of paperwork and denials I guess she received were just to much for her to comprehend. She finally gave
up because of this. I feel really bad for this lady, shes trying to live on 900 bucks a month SSD.
She should not have been treated this way, and I want to help if I can. Her husband was in Korea
and Veitnam. If you people out there can help me help her, I think it will be even better than
winning my own claim.

A friend of mine has not been able to get widows benefits, her husband was retired Army, with 25 or 30 years in service.
Is there a reason for this. She was married to the guy for many years. He was also a POW in Korea for a short time. I can't find
info on the supposed incarceration. But have to assume it's true. Why has she not been able to accquire his benefits. I need
some info on this.

It is Base Realignment and Closure. I think it is part of the DOD.
I may be wrong but I think that's what I remember reading. Yes, it is
related to the DOD. From what I have read the epa, atsdr, and some
other environmental groups are keeping track of wastes, etc.

Well, Berta, I learned something here. I have accquired the necessary letters. With all the backup Info I need. The letters provide and meet all the requirements you listed. They will be filed next week. I really hope that I can come back here and tell you personally that I won this claim. It's not for the retro or any other compensation that I might receive. I am to the point that that issue is not even foremost on my mind any longer. All I really want to do is help other vets with the same issues I went thru, and not come out with a mental disorder that was no fault of mine and blamed on something other than what It was. If you think you know everything about my specific claim (by what you read) or what I believe, you are sadly mistaken. I had serious issues with Events that occured and they are just as debilitating as anybody else's. I will prove this one way or the other, and I will do my best to help any other vet that has these types of Issues. If you think I am doing this for myself you are totally in left field. I will fight this system until the day I croak, because I don't feel like the military or The VA has any right to damage an individual in any way shape or form and get away with it, for any reason.
