    C-file is your claims file. If you have not requested a copy of this, do it now. It contains everything the VA has on you. Service medical records(SMR's), evidence, duty stations, C&P's, comunications between VARO & VAMC, etc.

    I have more symptoms and diagnoses. Just tired of thinking about them.

    It was a VAMC Dr that first diagnosed MS back in 94'. I saw him for general care.

    A private Dr agreed & I started recieving Social Security for MS from 1993.

    I recieved VA Pension for it in 97' maybe.

    I pushed and pushed the neurologist for years to provide a diagnose other than, Neumuscular Disorder of Unknown Cause. Finally in 2004 a neurologist diagnosed brain injury.

    A year later in 2005, Dr Bash diagnosed Multiple Sclerosis as directly related to service in the Navy.

    The VA had no problem with the diagnoses of MS as long as I stayed on Pension. As soon as I filed for service connection, I no longer had it.

    Ocasionally, my glucose is elevated. My liver enzymes are generally elevated.

    If I don't watch my diet, sugar intake and eat a little something serveral times a day, I will come real close to passing out. Comes on very sudden. No they say I don't have it.

  2. It was a bad C&P exam, I think, after reading what she wrote. and the AMC might just be giving me a chance to write a

    rebuttal because none of what she says jives with any other dr's eval/opinion. They are focusing on this one exam in

    the letter from the AMC, last paragraph. At least that's how I see it.

    Is the situation that you had a decision on a rating because the C&P exam was invalid? Or in general, you had a bad C&P exam?

    but I assume the docs have totally ruled out diabetes ???

    Also- when was your MS diagnosed?

    Multiple sclerosis is one of many presumptive chronic conditions under Service Connection by Legal Presumption, found winthin 38 USC 1112,1113, and 116- also 38 CFR 3.307-3.309-( all of the chronics SCed under this reg are available here under search if it fits into this criteria:

    The disability manifested itself to a degree of at least 10% within the presumptive period (those periods are in the rgs- MS has the most favorable presumptive period- Seven years)-

    NVLSP makes the point that symptoms alone that are characteristic of any chronic disease- if corroborated my buddy statements and/or medical evidence etc-

    can help the claimant fit into this reg- even if the chronic disability was not formally disagnosed during or within the presumptive period right after service.(usually a year for most presumptives under this reg.)

    How soon after your discharge was MS diagnosed?

  4. That is the kind of info I would like to put together to prove a point if nothing else. We should not have had to be exposed to that stuff/&&^%$. I feel the exposure at T.I was entirely too high and I want to try to prove it. this kind of info, I am sure will help,..... that's why I need this type of info, I'am totally convinced, has caused all mine. I appreciate your input.

    Sorry to hear of your long dilema, we hear you at Hadit and can share feedback if thats okay with you. Thank you for your service from one veteran to another. So relax, we are on board trying to see how it goes for you. An idea is to start another post specifically for your issues with the VA.   6. They were are saying in the SSOC that I had gone to a shrink 6 month's prior to my enlistment, for one thing. That is what the management center is basing thier decision on. Totally untrue. The C&P exam test they gave me (300 Question) Was so bad the couln't rate it. Current diagnoses from 1969 till the present Is the same, Major Depression, 4 mos of treatment at Oak Knoll NAval Hospital while serving, Discharged honorably. I have all the records prior to enlistment to the present.

    every thing shows that I was first diagnosed in "69" and Still have this Issue. Multiple diagnoses of the same. Been under treatment since 1995.Currently retired by SSD for the same. Don't understand IMO. DAV is VSO, Absolutely no help, other that submitting paperwork. Also this has to be the 9th time I've submitted for this since 1969, denied everytime. I have every record

    since 1969. Showing mental and physical health prior to and at enlistment saying I was perfectly healthy.The original C&P exam was for PTSD, and the PTSD claim was dropped from the claim by DAV's recommend, As well as a claim for chemical exposure, dropped also. The only thing remaining is the Major depression issue. All but one VA Dr. agree with the Major depression and all have written letters on my behalf, including civilian dr's. Even the Vet Rehab Center Dr's and LMSW's agree.

    Sorry, but I could be a lot more long winded. This is really getting irritating.

    Can you tell us a bit more. What do you disagree with and what have you done so far? Do you have a IMO? current diagnosis? VSO? what type of 'evidence' are they asking for? best to ya, cg
  7. How do I refute a lousy C&P examiners statement. my case is at the board of veterans appeals and the keep asking for more evidence. Is this just another cop out.

    I think this could be in the long run-one of the most important pieces of litigation that the VA has ever had to deal with-

    and I believe the affect-if these vets succeed- will have far reaching ramifications for all vets now and future veterans as well-

  8. You guy's should go look at www.mofo.com, They have filed a class action lawsuit against the VA.The file name is PTSD070723.

    I can send it to you if you need to see this, About 575 point of law that they have violated with reference to us.

    Not wierd at all, Pete. I had two C&Ps done by VA docs...both favorable and one from a QTC quack that wasn't. It's a dog a poney show. Words on paper...that affects lives and livelyhood. And some kid doesn't get to go to college because some quack is on the take.

    It's plain dollars and cents...someone else's or a bridge to nowhere in Alaska. A man or woman's sacrifice to their country isn't worth the cost of a cup of coffee.

    Altho' not very patriotic, I wish every man or woman contemplating entering the service would spend a few weeks here on Hadit. See the garbage that our governmant perpetuates on honorable Veterans and hope it changes their minds.

    I received a response back from the AMA. Canned propaganda. No help, no promise, no harm, no foul. They look out after each other like the band of thieves they are.

    There is no justice in Amerika, especially for those that protect it.

  9. Is it normal for C&P exams to be full of lies.

    Update:

    I called today and they asked me to fax a records request and they would send me all the c&p exam notes from each c&p visit.

    She said if I was missing something it was because I made my request bfore all the c&p examiners had finalized their notes.

    She wouldn't confirm or deny how many doctors or what information was in each exam records, so I won't know until I get them in the mail.

    She said it would take about 2 weeks to get the records in my hands.

  10. I remember 1968, and those situation very well. i guess what I really need to do is get names and illnesses that the rest of the guy's are now suffering from. I want to take the VA to the wall on this issue. I hope you understand!

    There is one part that is mentioned about hostilities to wards military personnel by bay area residents. I don't remember reading about this before. I lived it, just don't remember reading anything about it, except this one jerk that said we all lied about the hostile treatment. Any service member coming and going out of San Francisco or Oakland after 1968, got the treatment first hand. There were many of us that took beatings and some died before the Navy made it mandatory shore leave or liberty with a buddy. Many of us chose to stay on base, where it was safe. And how safe was it?

    We lived on this base. Took showers in it, washed our clothes, worked and trained on it and the SF people act like they're waiting for a new species to emerge from it, due to the toxins, "still" left behind.

  13. I have found that the dioxins are what caused the DM type II, mine has progressed to type I, and I came up with it at 35 years. I have seen all but the List of Toxic waste found. But finding info with reference to Site\Area 12, where the barracks were Is a little shakey. I know that there has got to be more vets out there that are battling the same type of illnesses. I've done the research, and I think this exposure caused my problems.

  14. I was wondering if you guy's know of a way to accquire information of diabetes cases and/or other pshycological issues,

    after serving at Treasures Island, San Francisco. Reason I'm asking Is that all the Barracks were built on a Toxic Waste

    site. I just want to see if there is any connection between the toxic waste and illnesses incurred after being stationed there.

    Right now It's curiousity.
