  1. My husband is 10% s/c for Gerds which we are seeking an increase evaluation based on medical evidence..

    but,,he had an upper I-G done and it shows he has a sliding Hernia hiatal would that be secondary to Gerds..or would they rate that along with Gerds

    I was originally rated at 10 percent for Gerd with a Hiatal hernia. I NOD it (useing the form letter Berta has) Listed my symptoms and was raised to 30 percent. I would NOD it in a heartbeat

    "The President has signed the National Defense Authorization Act into law. Combat veteran eligibility has been expanded from two years post discharge to five years post discharge. CBO is developing guidance for the immediate implementation of this expanded benefit and will be communicating detailed instructions over the next couple of days. Policy guidance in the form of a Directive has been drafted and is in the concurrrence process. Action has been taken to develop the business requirements to implement this expanded benefit in VistA though actual release of the software is estimate to be approximate 10-12 weeks from now."

  3. This is what I picked up on the BVA site from another claim :

    A letter was sent to the veteran and his representative on

    May 3, 2007, in which he was given 90 days from the date of

    the letter to submit additional argument or evidence in

    support of his appeal prior to the Board's readjudication. A

    letter was received from the veteran's representative in June

    2007 enclosing VA treatment records from April 2007 and May

    2007, along with a waiver of RO consideration of this

    evidence, and the 90 day letter response form, indicating the

    veteran's desire for the appeal to be readjudicated prior to

    the expiration of the remainder of the 90 day period.

    This is getting a bit stupid.

  4. Well I think I will win this one. Went to my local VA hospital today and got a copy of Environmental health Persian Gulf exam. It states write on it Dyspnea, Parenchymal scaring. So how can the VA turn me down for asbestoes for scaring on my lungs? The VA own C+P exam given by QTC says as least as likley then not that the Vetran was asbosed to asbestoes in the service.

    Anything else anybody can think of>

  5. I am 50% SC. I have recently been diagnosed with Hypothyroidism. It's pretty clear in my SMRs that I had this condition for some time, but was never formally diagnosed.

    Prior to taking medication (Synthroid) I had cold intolerance, constipation, hair loss, weight gain, etc... After a year of treatment, these problems have cleared up.

    If I attempt to get an SC for my Hypothyroidism, the most I probably would be rated is 10% since the medication is working--right?

    Is it even worth the bother? 10% plus 50% is 55%. No extra pay. Is there any reason to get this service connected? Or should I save myself the grief and aggravation of dealing with the VA? I'm dreading the thought of IMOs, C&Ps, NODs, etc..

    Yes it is worth it. 50 plus 10 does = 55 in VA math but if you hit 55 percent you get rounded up to 60 percent. GO FOR IT

  6. Thanks so much to all who responded, especially the advice of John999. I will take my civilian test results and letter to the QTC guy. .Here is where my anxiety pops-up:

    In the letter from QTC, they list questions with answers. For example:

    Question: Should I Bring My Medical Records?

    Answer: “No. Please do not bring your medical records. The doctor will only review records the VA has already provided. If you have additional records related to your claim, please submit them directly to the VA.”

    Also, after doing a search at hadit.com about claim files being present during the exam, I have seen various answers. Most say that the c-file should be present and must have been read. No c-file was provided to QTC. Even in the book “The Veterans Survival Guide” by John D. Rhode he says “Failure to review your file is a violation of not only of Physician’s Guide but also of federal law” Is this not correct?

    My last C+P for my back at QTC was directed after a DRO hearing. I asked the Dr if he had my VA medical file to include my xrays and Mri he stated he did not

    Guess why I got low balled for 10 percent for my back

    I forgot to give you this phone number 1877 327-4457 When the recording comes on asking if you want to stay on the line press 1 then it will ask you if you have recd a letter from DFAS punch1. Then wait and wait and wait then talk to a live person and due what I due ask nicely WHERES MY MONEY? They will look in the computer and give you an update.

  8. I Retired with 28 years May 31, 2004. Initially rated at 50% in the start and moved up and up and up until finally 100% retro to April o6 and last but not least 100% retro to the day after retirement June 1 2004.

    In my last award letter they got the following as far as CDRP and retired pay.

    total award----amount withheld----monthly entitlement----Payment start----reason for change

    2239--------------1589-------------650-------------------Jul,1,04---------with hold for CRDP/ret pay

    2523--------------1873-------------650-------------------Dec 1 04---------same as above

    As I prev stated I was initially rated at 50% which was the thresh hold for retires with 20 years not having anything with held(as I understand it), This Crap has got me baffled.

    Things have not gotten any better for me.i requested 2 weeks ago to see an outside dr.

    from my local dr. and still have not heard a word about it.

    My ex who abandoned me after we visited the wall and ptsd was triggered had the eviction court date changed untril the 29 th of the month.

    My flashbacks continue and I am asking if you might be kind enough to put me in your prayers tonight.I am so tired of being alone thru all of this and the whole va process.

    The local vet agengies act as if I was a criminal and the va does little to keep me up to date on things.Some days I wonder why I am not a name on the wall.It is so apparent to me why so many vets have comitted suicide when they were suffering the pain of ptsd and

    not being able to find the help they need.Makes me feel or sound like i am unpatriotic to have to speak this way.but the fact remains..ALL VETS DESERVE HELP WHEN THEY NEED IT..WE ALL WERE THERE WHEN THE COUNTRY NEEDED IT WITHOUT ANY DELAYS.

  10. Hello to everyone on hadit. I had been on this site for many years as "Jarhead". I'm now logged on as "Jarhead1", simply because I had problems logging on as "Jarhead". I've sent Tbird a message hoping to correct the problem. Anyway, I spread the word throughout the Veteran community that there is no one single person who has helped Vets out more than Tbird. I'm a 100% Marine Viet Vet from the Boston area. I dedicate much of my time trying to help Vets and their claims. The first recommendation I offer them is to log onto Hadit.com for the absolute best advice.

    Thanks again for all you do Tbird,, and to all the others that constantly help our brother and sister Vets. It's great to be back and promise to stay in contact. God Bless !

  11. Last time I called 1800 re dependents retro, told could be up to a year to get the $ from increased rating last summer. Maybe just before school time clothes/supplies? oh well, better'n last time, said somethin bout outsourcing to another varo to get it done! (my whole Cfile moving, oooh, scary!)

    Guess I will claim it probally next week. Think I will take a week of from worrying about my claim . I will ask for an increase for Skin cancer at the same time and let them know I am now up to 500 mgd a day twice a day of codine for my back.

  13. I have tried twice for Tinnitus and turned down. I might try again so I can get the disability waiver on life insurance as the VA now has given me a hearing aid.

    How can they turn you down for Tinnitus. They gave it to me without even clamiing it. I put in for High Frequency hearing loss. The QTC Doc asked me about rining in my ears. I told her 2 to 3 times per week. Next thing you know disproved for hearing loss. Not bad enough I guess and approved for Tinnitus.

    I posted yesterday about winning my claim going back to August of 04. Well today I finally took a moment and really read thru it. Yesterday I was on cloud 9 after a 3 ½ year battle I had finally won. The rateing of 10 percent for my neck and shoulder pain was a fair rateing. I told the C+P Doc the truth that I am not in pain every day but that some days are worse the others.

    Here were I have my big question. The examiner diagnosed cervical spondyloarthropathy most likely secondary to cervical degenerative disc disease with myofascial syndrome. My question is since I am not service connect for cervical degenerative disc disease with myofascial syndrome. Should I know put a claim in for it? If so does anybody know the rateings for that.

  15. Jim, Good SC 10% up to 80%! (applied for tdiu yet?) By the way, does DFAS show your crdp? Mine did a few months later. Your 60% was 'awarded' in 05? My 60% (ED 05,06) was awarded&paid in 07. You may want to contact the va by iris (cya) about the backpay? I was told what group I was in at least. VA direct deposited the $ unannounced, then I got the letter detailing how it went. Tax free retro check, I'm thankful. best to ya, cg

    I am hopeing to get my retro by next xmas this crad program has beeen a joke. I looked at the chart someone posted here a while back and according to DFAS they have fixed all the orignal claims. I guess they just forgot about me. Called them today and they said they are working on it. Have not applied for tdiu yet can still work

    So are you saying, 10% SC granted for right shoulder, and neck pain retroed back to

    Aug 9, 2004 --- and that now makes you 80% SC'd

    Or are you 80% SC'd from the retro date od Aug 9, 2004 ??

    Sc back to Aug 9th 04. Filed in Augst 04 Recd 60 percent in Sept 05 Appealed a few Items raise to 70 percent April 07 Went to DRO hearing Now 80 percent back to April 04. Still never recd a dime of back pay thou being a retire

  17. The brown envolope came today service connection for Cerical Spondyloarthrophathy (claimned as right schoulder and neck pain) granted at 10 percent (low balled.) Back to August 9 th 2004. Well now at 80 percent.

  18. This does not surprise me, it appears blocking is their goal. They have always made VA claim filing so complicated and so back behind the mayonnaise and hadit had messed up their plan. I'm sure the VA people spend much time sneaking around on hadit.com trying get information to do damage control in their mess-ups. They say we are just paranoid. I'm sorry I have lost trust in them and they are making no attempts to restore the trust to anyone. I'm sure there is some bogus claims, but they treat them all as such.
