Deferred For Medical Poinion "opinion Recived"

I'll filed this claim June of 2006.I had my C&P Sept. 2006 claim for right knee was deferred for medical opinion on May of 2007.This is the doctor's opinion

*I feel that in compairing the patient's orthopedic consult from Sept. 19th 2006 with findings of medial compartment arthritis, as well as the patient's very specific complaints in 1972 and 1973 of a locking sensation, pain and catching, it is at least as likely as not that his current knee condition is related to the treatment noted in the service medical records."

How does this sound to you guy's? A Go or No Go?

Any idea on a rateing for knee that's in pretty bad shape going by my C&P exam.

At leat as likely is are the magic words that puts the MD opinion as 50 percent sure t he Knee is related to service. This should award SC or at least envoke the benefit of the doubt rule.

Sounds like a congratulations may be in order.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

Sounds to me that the VA is dragging feet, and trying to see if one of the inhouse or "captive" doctors will render an opposing opinion, based on the C&P. You may also get another C&P request. A second C&P just to refute the first one's results is not considered cricket, but who ever said that the VA plays by it's own rules. (Unless called to task.)

GET an independent medical opinion(s)from (a) board certified specialist(s) if at all possible.

I did not get the impression here that they want to give you another C & P-

I think the C & P statement you posted here should definitely service connect this condition.

No they are NOT requesting another C&P, as a matter of fact it is at the rateing board now. I just called the 800# very good info from the guy talking to me.He said here at Pittsburgh and other RO'S they are trying to work off claims that are over 1 and a half year's old!! Also said I should hear something in LESS than 30 day's we will see about that.

I did not know how far back you could in years that is to file a claim on! This happen in 1972, and I still suffer with it to this day. I went to the ortho clinic

at the Pittsburgh VA hospitle, doctor said I may need TKR later on down the road I sure am glad it was still written up in my SMR's, I think this is what won my claim

hopefully that is, still no dission on it yet soon I hope.

They wont pay you back to your service date-they only pay retro back to the date of the Va's receipt of the claim-

and in a few cases a TDIU vet can get a year more than the EED claim date.
