We discussed this at hadit years ago and it doesnt come up much-

any veteran who is at 70% level and has marginal employment as described within this 2007 BVA decision can be fully eligible for TDIU award:

"Marginal employment" is employment you are paid for that does not reach annually either the poverty level rates or could be considered as substantial and gainful employment.

Call, I need 95% or higher to get to 100% schedular. I have a claim in for HBP that should do it if approved. 10% of 5.5 equals .55 added to 94.5 equals 95.05% rounded to 100% schedular.

I am paid TDIU but I defer back to Berta's original post about TDIU and marginal employment.

I filed for SSD. I am 18 months into the 24 month waiting period to visit the ALJ. If and when I get SSD I will retire. Terry Sturgis
