HadIt.com Elder Chuck75 Posted May 8, 2008 HadIt.com Elder Share Posted May 8, 2008 Today brought a brown envelope from the VA with a bunch of white and green pages. Significant details-- Retroactive increase for DBII compensation from 10 to 20%. Oddly, the original compensation award was effective in the middle of a month, and the retro was awarded starting the first of the next month after the initial award. Several issues were deferred, and a statement that we have requested a (C&P) exam, with a "you should have already received notice" concerning the exam. (I have not received any details concerning the exam to date. The medical evidence already submitted is enough to establish more likely than not. I worry that the C&P was requested only to generate a dissenting opinion. If so, they better have a board qualified in specialty examiner conduct the exam. (Four or five favorable medical opinions from VA primary and board certified specialists are already in my records.) Two issues were denied, and I am currently writing/editing the NOD reply. One issue is going to be very messy, due to missing military treatment records, injury under and related to combat conditions, and with possible additional loss of records due to enemy action. The second denial issue is related to loss of function of one of a pair of bi-lateral organs due to a duty related condition and surgery in a military hospital. The denial is in part based upon the fact that the other organ of the pair is fully functional. This seems to be in direct conflict with the appropriate reg section. Unfortunately, the reg does not really directly address the exact situation.
Guest terrysturgis
Congratulations Chuck. I assume the 20% is for type II diabetes. Have you looked at the DMII traning letter that the VA uses for DMII to see if you have any secondary conditions such as HBP, PN or vision problems? Use the search to find it. You have the door open, keep pushing till you get the benifits you have earned. Take care. Terry Sturgis
