The BVA sent the claims file back to the Regional Office to rate. This is where the question of the "unemployable" from the Non Service Connected Pension is coming. If you were granted a Non Service Connected Pension with Chronic Anxiety listed at 50 % with the other non service connected illness and "unemployable". Will the "unemployable" carry over to the Service Connection grant. If the Non Service Pension effective 2003 declares you unemployable since 1983 can the VA take this away from you. I would certainly think that you have an inferred claim for being unemployable - and if they don't acknowledge it - and grant you less than 100% - you can appeal that pretty successfully. You have consistently maintained you have been unable to work. Your file indicates you are unable to work - and THEY determined you were unable to work. This isn't a case where you would be going back in later and saying "Hey, you didn't ask if I was able to work..." This is a case where the file CLEARLY SHOWED you are not able to work. So they SHOULD consider the TDUI claim, regardless of whether you filled out a specific form. It is kind of looking like you will get a big chunk of money, but still have to fight for the rest. I have never tried it either. I would have two page 5's and no 6. I would have loved to have been able to paste each page and place them all together, but the pages wouldn't let me do it. Free, There is 12 pages to the BVA grant, if you can read them. I doubt that it will ever go on the BVA decision Board, for it has the same docket number as the first stupid write up. At least this Hal Smith had enough sense to know what my claim was about. I think that I filled out that TDIU form when I first filed for benefits, as the counelor at the R. O did it. To me the Non Service Connected Pension is very clear that I had to give up working in 1983. The VA secured their information from somewhere to write up that Non Service Connected Pension. I don't see how at this time, they can get out of paying at least back to 2003 with the 100% and unemployable, even though they state 1983, they have placed effective date June 2003.
