R.o Constantly Loosing My Papers

In May I changed my POA, mailed the correct form to the Huntington

DAV. I just found out now almost three months have passed and the R.O

lost the papers.

I faxed this Case worker another copy and here are his replies to my

claims.

Did he tell me anything or just being his usual smart ass self?

I have no ideal if the Certified Copy of my last 5 years of

employment from Social Security will be any benefit to my TDIU Claim.

I have not worked since 1983 and it seems that it is not my fault the

VA didn't secure my medical records to receive benefits years back.

Sure they paid me 16 years retro, but feel that I am on the short end

of the stick.

How can you keep proving a claim that is so darn many years old.

Here is his reply about my claims.

In reply to your last inquiry, we provide the following responses:

1) We have received and filed the VA Form 21-22, Appointment of Veterans Service Organization as Claimants Representative you recently submitted.

2) The expected time to complete your claims depends on many factors such as the timeliness of obtaining evidence, the current workload of our offices and mandatory periods of time required by law to allow not only the Government to gather evidence but yourself to submit evidence. We are trying to decide your claim as quickly as possible. We appreciate your help.

3) There is no reasonable need to explicate details of our policies, procedures, regulations, codes, methods and/or systems used in making decisions related to Dependency. However, we can say that due to the nature of Dependency claims, they may sometimes be completed without a Ratings Board Decision.

4) As for the Unemployability issue, you may submit a copy of your certified work history from the Social Security Administration if you feel this evidence will support your claim. As with any claim, you may submit any evidence in support.

Larry,

How long to get it out of the mail room and logged in?

I need to get a copy of my C- File and I don't know when to ask for

it.

I don't want my year to run out to bring a lawyer in.

When is the time to do anything?

I may still be sitting here a year later waiting for the VA to decide

the unemployability claim.

Betty, you just NOD what NEEDS to be NOD'd.

You CLAIM what you now know you should or should have alread claimed.

If you feel that you NEED to get a lawyer, from what you know now about you and your claim(s), then for goodness sake, get one now. Don't wait until you realize that there isn't a chance for your claim and time is running out.

And, yes, you may very well be waiting a year on your TDIU..........I've been waiting 8 months for a DRO hearing on MY TDIU, and, then if he/she decides in my favor, I'm sure it will STILL take them another 6 months to simply piece together my retro and get my monthy compensation amount taken care of.

Sorry, darlin, I don't intend to be so "negative".....I'm just sitting here, sitting on my catheter (sp) tubing, which is inserted quite deeply in my yo-yo, suffering the most horrific bout of prostititus, experiencing abt 102f. and this warm and fuzzy feeling where my urine bag is straaaapped to my leg, swallowing tylenol #3 like they are M&M's and seriously wondering if I can make it 'til Monday to see the VA doc again............getting old comes in at about 29" of True Vacuum.

I haven't made a "dump-pass" by the john in a couple hours, after drinking as much water as I can hold..................and I'm starting to get this kinda "yellow" outlook on life!

To be honest with you, I believe I just might shut up if the VA would

go ahead and give me the TDIU.

I hate to argue with the VA, but I honestly think that if I have

a piece of paper that is called a Non - Service Connected Pension,

which states the VA declares you unemployable since 1983 due

to disabilities and then you later service connect those same

illness, how can they possibly say you are employable now.

As I told that Case Worker, just because the VA denied me the Non

Service Connected Pension, due to excessive income of my husbands'

it sure didn't make the illnesses go away.

As for a DRO Hearing, I could never do that. I would have to

control my anger for the Huntington R. O and this I cannnot do.

The VA is trying to tell me a Non Service Connected Pension is

never considered when you are rated for Compensation.

If it is the same darn illnesess, I do not see how this

paper has no importance.

I would love to see " Lola".

Betty, i would like to know that as well..As im currently NSC pension. I have read the regs where they say, i believe, that the rater is not to consider any NSC disabilites for pension purposes, when SC claims have been submitted, but i cant see how they cannot. Its baffling too me. I understand the financial reasons for NSC Pension, but if your unemployable and 100% disabled for NSC Pension purposes why doesnt it go across the board, automatically into SC Claims.????..Peace, Bill

Betty, i would like to know that as well..As im currently NSC pension. I have read the regs where they say, i believe, that the rater is not to consider any NSC disabilites for pension purposes, when SC claims have been submitted, but i cant see how they cannot. Its baffling too me. I understand the financial reasons for NSC Pension, but if your unemployable and 100% disabled for NSC Pension purposes why doesnt it go across the board, automatically into SC Claims.????..Peace, Bill

Do you by any chance know the regulations pertaining to this.

This makes absolutely no sense to me.
