gp747
Lawyers representing veterans have to be fully accredited in some way by the VA-this was discussed here last year-and is on the VA OGC web site: http://www.va.gov/ogc/accreditation.asp 30% is not the going fee -20% is. A lawyer who handled some business for me last year started telling me of his VA claim at the same VARO I deal with-as we talked on I mentioned a little about my claim and he asked the monetary value of it-I had just prepared a total for the OGC regarding a complaint I have there. Suddenly he wanted to represent me-and sent me emails to come in with my paperwork-but when I emailed him the actual accreditation criteria involing the June 20, 2007 regs- I didnt hear from him again. The claim he was interested in did not fall under the June 20, 2007 regs-only my CUE claims do and since he had already told me of his problems with his own disability claim-and didnt understand what CUE meant-I realised he didnt have a clue. Veterans have to be careful who they hire. Not long ago 2 lawyers were found guilty of stealing veteran's fiduciary comp money. Ask a lawyer you are considering to hire for some of their past veterans cases. or search their names in claims at the BVA or CAVC web site. thanx berta
gp747
I AM TORN UP AS TO WHETHER TO FILE A NOTICE OF DISAGREEMENT ON MY RECENTLY 30% BI-POLAR SC AWARD ,OR WHETHER TO JUST GO FOR AN INCREASE AND MY SECONDARY CLAIMS . THIS LAWYER I AM CONSIDERING SAID THEY WOULD FILE NOD FOR ME AND ADVISED ME TO DO SO. AND THE ONES BERTA RECOMMENDS THAT I WOULLD LIKE TO GET PROBABLY WILL WANT ME TO FILE NOD FIRST WHICH I AM WILLING TO DO , IF IT IS THE PROPER WAY TO GO. I DONT WANT TO LOSE WHAT I HAVE OR GET A REDUCTION BECAUSE I HAVE BAD LUCK WITH ANOTHER C&P OR SOMETHING ELSE GOES WRONG. ALSO LAWYER SAID THEY WORK FROM RO UP. Tig
Well Skunk, I retained them when my PTSD claim got to the appeals process. They were charging 20% of retro or back pay, but after June of 07, they are now asking 30%, plus expenses for copies, postage, mileage, travel, ect.. I just got a mailing advising me, if I didn't sign another contract with the new fees within two weeks my file would be "scheduled for destruction". I'm going to call them today and I'm thinking I will be looking for another POA, since the first agreement I signed wasn't good enough, lol..
