Question

As some of you here know I went to the ALJ hearing and I have questions kinda burning at me. My AlJ made a "Bench Decision" I have waited 2 1/2 years for this hearing now with that said how will this work out? He dated it back to November of 05.

1. Will I be on or rate at SSI rate till the SSDI kicks in after 2 years? I think?

2. Will my children receive back pay as I will?

3. Will the SSA set me up on SSI for back pay and add my children and wife on when the local office calls when they get my letter from the ALJ?

I was told that being my decision was made more due to ptsd and I am pretty sure that my lawyer said it may be go SSI? but I have disabilities too? how does this work? or will this be in my letter that is written by the ALJ? The Decision was fully favorable.

Rich,

if you earned the credits for SSDI prior to 2005 when you filed and made sure all your dependents were listed on your forms, than they should pay SSDI back to date of filing. Your dependents will generally be included in the back pay.

Around 2 yrs after your benefit grant, you'll recieve your MEDICARE card.

If you don't have the work credits, You will recieve SSI instead.

I would give them a couple weeks & give them a call to make sure.

It took me a little over 90 days from the time I recieved the award letter from SSA before the $$$$ hit the bank deposit.

Rich - at the time you filed your claim the SS office should have made a determination on SSI. SSI is a needs based payment (most consider it Federal Welfare). You should have received a decision letter on it shortly after you filed your claim.

Your SSDI claim which you recently won will go back to the date of onset, which according to your post was Nov 05. You will not get anything from Nov 05 - May 06 (6 month waiting period). Your children will receive back pay also. It may take a few weeks for all of it to come together but it will happen.

I don't see how you would not get SSD unless you are disabled but did not earn enough quarters to qualify. If you get SSI they will stop paying when you get VA Disability.No matter you have a good payday coming and your kids should get 1/2 of what you are awarded.
