Question

I am trying to help a Vietnam Vet ( my old Boss.) He is currently rated at 80 percent in VA math 60+30+20+10. He was just approved for the 20 percent for type II Diabetes for Herbicide Exposure. He was also turned down for I.U we are working on his NOD. I want him to go straight to a DRO hearing since I have had lots of luck there. Is there a way to ask for a hardship to make it go quicker? He lost his job due to them closing the place where he works and no one will touch him now due to his age and SC conditions.

Jim,

1) How old is he?

2) Has he received a foreclosure notice on a Mortgage

or an eviction notice if he is a renter?

3) Does he have Medical Evidence that he will die very soon?

These are the type of things needed to get hardship consideration.

Now sounds like the perfect time for him to file for tdiu (total disability due to individual unemployability). For that seems to be what you are discribing.

He'll have to file the proper form and I can't recall the form number, but it is available for download.

Now, if he is in dire straights and has received letters from his mortgage company.......then he needs to contact his Congressperson and get them to FAX the VARO with that correspondence and a request to expedite his claim. That actually works.

Just as Carlie has pointed out. And, it's about the only way to get anything speeded up in the VA system. Ya gotta be near death or near homelessness or both.

Be sure and file for Social Security but he will need a strong IMO saying he is unemployable but that should also help with VA.
