My Congressman's Office Wants To Know

Question

I wrote my congressman a 5 page typed letter yesterday and faxed it to his office.

I got a call today from his office and the guy asked me what I wanted the VA to do..................I got so pissed I couldnt talk, The obvious answer is I want the VA to do the right thing!

I told him this morning I was on my way to the VA hospital-----and I was. I told him I would call him back tonite. What should I tell this guy I want????????

On another note, today the urologist scheduled me for surgery today in mid april to remove kidney stones...........

Im gonna call him and tell him I cant answer his question specifically today.........but I want the VA to do the right thing........please help me here. what should I tell this fine gentlman

It looks to me as though they did not address your medical evidence or- in one case- failed to use a goinometer and I think your past posts showed definite evidence of a higher rating for that condition-

This is probably a congressional liason person - I spoke to mine many times during the 1990s -they need direction as to what they could do-or what you want from them-

You certainly want the VA to consider your evidence carefully-

maybe this guy could call the VARO Director directly -if he is willing to do that- for some assurance that they will consider your evidence properly-

Our senator's office asked me the same thing about my husband, and then when the denials came the VA contacted him first. He called to tell me the results and he asked how I want him to respond to that too. (I'm working on that now.)

They do need direction. The fine gentleman I'm working with told me he is not trained in VA regulations. Then he asked, "What is your background? Are you an attorney?" I was spewing forth CFRs right and left and he was totally lost. Made me wonder how he can be a veterans' representative if he knows nothing about it. I guess that's politics.

DVS law is really different from the regular legal system.

My local congressman's representative hates to see veterans coming and he hid from me once.

He thinks PTSD means that the 'baby-killers' are always locked and loaded.

He ain't old enough to remember the Viet Nam stuff.

He made it quite plain that he wanted nothing to do with us.

Before I got a lawyer I was planning on picketing his local office just before election day.

My lawyer told me to cool it.

It's up to us to help each other.

I called the "gentleman" from the congressmans office today. I told him I wanted the VA to do the right thing. I told him I couldnt work, I told him who is gonna hire someone with a disabled right hand/arm, I asked who was gonna hire someone who cant pass a urinalysis because they are constantlly on narcotics. I told him they need to reconsider this asap and I wanted my personal hearing scheduled by April 1st. He asked me how I know they didnt consider there own records, I told him because in the SOC they list what evidence they used. He saiud he was going to send them a letter asking for immediate reconsideration and to have my personal hearing scheduled by April 1st. I told him there is no back pay for me, I am retired..............I told him this cant wait another 6 or 7 months. I told him the VA is treating me for depression, why do I have depression, because of my spine........... WTFO :P

What I really wanted to tell him is that shit like this is what causes people to go "POSTAL" but I dont need a goon squad showing up at my house..........

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
