they have job security they work for the federal government lol they have to work so many files a day, in order for the managers to obtain ther bonuses every year, nothing says the files have to be worked right, just get them off their desk, let the vet appeal to BVA, just work this many files a day and everything is fine at work, so what is a vet has to wait 3-5 or 10 years before they obtain benefits they will get them if they are persistent, in the meantime the VA employees are all getting their paychecks it's the vet and their families that are paying the price for this processing system, take away the bonus system and maybe the files would get worked right to start with.... again just my opinion

FLHRCI: Don't think your the only one who couldn't sleep and felt like ranting a bit. It's now official, I've been up my self for twenty-four hours now. Thoght about taking an extra sleeping pill, but them I may find my self sleeping through today.

When I learned how much an SO gets paid to do his job and then a VARO clerk, I keep kicking myself in the you know what, I could have done as good or as bad in this case as they appear and actually do. Only thing wrong, would be the fact I like to read. Just about anything I read will keep me interested, that was until I started getty sick and all.

So have a good rant and I hope you get to sleep sooner than latter, cause then you would rather stay up than sleep away another day.

Terry: My take on making 29 thousand a year, If I weren't a Veteran and had no conscious or could care less about others, I wouldn't mind making that kind of money sitting around giving out, outragious information to see how comfused I can make some one be, Rubber stamping denials using computor generated letters, and laughing along with the others at the VARO when we see the Veterans loose everything they have because of the game deny, deny, deny we play on them all the time. Go out and have fun on hollowdays and vacations, letting the claims sit and flaunder while I am away.and If some Veteran really gives me a hard time about his claim, I will see to it that things get misplaced or even lost, depending on how bad a time they gave me. But if that doesn't seem to get the claim and Veteran out of my hair, I will send it to another VARO where they can play the same game with it for awhile.

But allass, I do have feelings and a conscious and truely care how my actions may effect others, I am so against violence, with the exception of sports, and even that sticks in my throat sometimes. No I probably would not last long working at the VARO, I just wouldn't fit in and if I saw anything that appeared to be a conspearicy or wrong doing, I would probably be a whistle blower and be hated by my Co-workers for making them a target for an investigation and putting their jobs in jeopardy.

But since I know how to read and comprehend to well, I would probably pass an intrance exam or training course with to high a score for them to hire me, that is, if I wasn't so messed up in that department these days.

Well go to go shopping now before the next storm hits us. Oh YEA, Why does it seem that the SO's seem to have the same set of rules, "to clear their desks of cases, even if it means short cutting the claim so if the Veteran wins, it means they will have to appeal the decision just to get the proper rating, which more likely than not should have been awarded in the first place had the SO truely put in the time so this does not happen.

I thought the shole idea of the SO was to help Veterans navigate through all the mess and get the highest award they deserve and not some hand out, take it or leave it type award.

Does that tell you how I feel about making 29 thousand dollars. It's whole lot more than I make now, but I just could not live with myself to take it, knowing what it would mean to so many other Veterans, who would prefer to be working, than on disability like me.

Got to really rush off now. LoL

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
