Question

MNANG(52D) from 94-97 perfect service, no problems..... joined RA in 97 suffered injury at Benning. Ended up getting OTH in 1999 with time missed(416 days) due to said injuries. Things unfolded in 05 when I got diagnosed with a slew of things like GAD,Panic disorder,Agoraphobia,Major Depression,PTSD and I think I have TINNITUS. So in short I have 94-97 NG time =good and 97-99 RA with a backmark= OTH with narrative reason "in lue of trial bt court martial" Any thoughts?

Just got the NOD and I'm not sure how to work the correction papers they sent? They sent a DD293 and DD149 form. I don't want to screw these up, any sugestions on to what I should do or who to see? Thanks~

Did you file the DD 293 yet?

"VA benefits are not generally payable unless the period of

service upon which the claim is based was terminated by

discharge or release under conditions other than

dishonorable. See 38 U.S.C.A. §§ 101(2), 101(18); 38 C.F.R.

§ 3.12(a) (2008)."

There is considerable info here at hadit as well as at other web sites on Discharge Upgrading.

The VA web site, under BVA decisions- also-if you put discharge upgrade into the search browser, will bring up cases that will give you some idea of how these upgrade cases are handled.

If the VA ultimately grants you a character of discharge that would provide you with potential compensation then they will process your claim.

Every disability you claim needs current diagnosis and a nexus (link or cause) to your service.

As you said in June = a ton of S--t to do-

this type of situation can involve quite a bit of work but it is not impossible to get this type of discharge changed -based on evidence and circumstances)

As you can see here it is taking VA years to resolve claims so with the 293 matter as well- I suggest you respond in time to every the VA sends to you, prepare and file the NOD raising argument with whatever they stated for denial, and then begin to support the DD 293 request with whatever info they ask for.

It sounds like your military medical records are at the VARO that has your claim.

Try to see if they will send you a copy of them- your personnel records as well and all military records for both periods of service will be needed to prepare a strong argument for the upgrade.

Once you file a NOD you would be able to hopefully find a lawyer versed in upgrades as well as VA claims.

They will charge a fee but it would help to have their support.

Or you could try to find a good vet rep who will help you on this upgrade matter.

There is plenty of info on the net and upgrades can be done but it is often not easy at all and it definitely will take time.
