Question

Anyone out there in hadit land gotten sleep apnea re-rated P&T?

Just so I'm not confusing the issue, I'm 50% for OSA and on a CPAP. On my original claim, the RO stated the condition could improve, therefore I am subject to future exams.

what I would like is the future exam now and to delete the "could improve"

Okay, what I really want is 100% P&T schedular for the Chapter 35 benefits for my daughter (nursing school), and possibly my son (special needs job training).

and on that note...do I need to ask for P&T on top of everthing, or will 100% schedular with nothing subject to future exams/improvement automatically give the P&T and the Chapter 35?

hi,

I can not answer your question, but I have one. I am in the process of prepping up for my upcoming OSA claim as secondary to few AO related issues. My OSA was incurred after 40 years from service discharge.

If you could share how your OSA was granted would be a great help. Thanks in advance.

12R3G it depends on the type of Sleep Apnea you have been diagnosed with.

If it is Obstructive then there is little hope unless you have developed the right sided heart failure or Corpumonole.

a lot of folks who have OSA and no not get treatment wind up with Pulmonary HTN which would get you 100 percent P and T.

Central Sleep apnea is a different issue and can be rated permanent and total because the underlying factor is the CNS.

Bob, I think sleep apnea secondary to Agent Orange is a bit of a stretch. The only way I have ever seen sleep apnea granted was if it was diagnosed while still in service. It's not a presumptive condition for Agent Orange, or even subject to presumptive service connection if manifest within one year of discharge.

Maybe if the sleep apnea is secondary to a condition which is secondary to herbicide exposure...

If you have a combined 70 percent (and it sounds like you're close) all you need is for your SC disabilities to render you unemployable. Chapter 35 benefits come with that. Getting a medical opinion regarding whether your sleep apnea was permanent or not is something the C&P doctors should be able to do, then you can get started on your IU claim.

100 percent schedular with no future exams will get chapter 35 benefits. IU is a moot point if you're 100 percent.

I think something that could be of some help here would be an example of an IMO for Sleep apnea secondary to a service connected condition.  I wish I could produce it but I have not a clue how that would be worded.  I could guess but someone that has actually done it would be better than just the common sense route.

Jbasser...thanks, no thankfully, I do not have the conditions that would rate OSA above 50%...

bob...I was diagnosed and began treatment while still in service, so SC was pretty much a non-issue for me.
