What To Do If C&p Doc Diagnosed Me With Something But It Was Not Considered?

Question

Well, I was going through my c-file and noticed that the doc diagnosed me with tinea pedis that I did not claim. Since I was NEVER seen for this in service and it is not in my SMR, can I now file a claim for it? If so, how do I?

Keep in mind, my C&P was on 10-22-08, I retired on 10-31-2008. Can I still use his diagnosis to file a claim for tinea pedis? Does that mean I should file a NOD?

I myself might go ahead and file on it,

being that it was shown on your 10/22/08 exam,

especially if I had residual effects.

Are you sure that the 10/22/09 exam was a C&P exam ?

That just doesn't sound right since you retired on 10-31-2008.

As far as I know a C&P exam is done by VBA not DOD,

but Im really up to snuff on this program.

Was this throught the BDD system?

I am positive. It was my first one done by QTC. Yes, I filed under the Pre-Discharge Program (BDD).

When you file that NOD you can add the Tinea Pedis in there

if you want, I'd send VBA another copy of that exam and highlight it.

Did the doc that wrote it on the report say why and where it

may have as likely as not come from.

Do you have any residual effect from it.

If you get medical care somewhere, start a paper trail

if it needs to have treatment.

You might want to study that BVA decision to see the how's

and why's of it being SC'd.

No, he didn't say where it may have come from. No residual effect. Thanks, Carlie, you are truly an asset to this board. I pray that the RECONSIDERATION for my Lumbar (with Radiculopathy) will come back with a favorable decision SOON.

So, I should file a RECONSIDERATION versus a NOD on my ankle due to my 10% rating and I feel it should be higher based on my ROM tests I had while in service? I haven't filed a RECONSIDERATION on it yet, anyway. Or will a NOD be better based on my ROM tests I had in 2006 and the one that I am having on March 4th?

pilgrim,

I reserve any comment on whether you should file for a recon or the NOD,

just be sure whatever you do is in a timely fashion.

Filing for a recon does not stop the one year NOD clock.

I feel sure the VBA will want to use the most current medical evidence.

That will probably be from your March 4th ROM measurements.
