Question

Don't know if this is going to work! Have 20% diabetes/ now on insulin daily. Question, been diagnosed with neuopathy left leg etc. Gotten much worse getting in right leg too. Will they add 20% to current diabetes rate? Have rating of 10% on left leg already will that be another 10% or will that rate be figured into diabetes? Excuse the lay terms. God Bless us all, the lost and the ones who feel lost.

Have you fprmally claimed the neuropathy has gotten worse in one leg and is now in the other leg?

Is your 20% DMII rating compliant with the regs:

Under Diagnostic Code 7913, a 20 percent rating is assigned

for diabetes mellitus requiring insulin and restricted diet,

or oral hypoglycemic agent and restricted diet.

The next

higher rating of 40 percent is assigned for diabetes mellitus

requiring insulin, restricted diet, and regulation of

activities (avoidance of strenuous occupational and

recreational activities). Diabetes mellitus requiring

insulin, restricted diet and regulation of activities, with

episodes of ketoacidosis or hypoglycemic reactions requiring

one or two hospitalizations per year or twice a month visits

to a diabetic care provider, plus complications that would

not be compensable if separately evaluated warrants a 60

percent rating. A 100 percent evaluation is applicable for

diabetes mellitus that requires more than one daily injection

of insulin, restricted diet, and regulation of activities

with episodes of ketoacidosis or hypoglycemic reactions

requiring at least 3 hospitalizations per year or weekly

visits to a diabetic care provider, plus either progressive

loss of weight and strength or complications that would be

compensable if separately evaluated. 38 C.F.R. § 4.119

(2008).

If you feel your DMII falls into the 40% rating-this is the time to claim that too as well as any other complications you might have due to the DMII- such as the PN.

Berta, got 20% before starting lantaz Sept '09, on shots daily,with increase every other day no hosp. because wife has an eagle eye. Advised to restrict activities & diet. Diagnosed peroneal nerve compression Oct. '09 am applying more PN have 0% now, left leg numb to upper calf, right leg mod. with tingleing/numbness starting in hands. dble med for bp since April, will this have anything to do with increase on bp? At Neuro Dr. bp 163/80 she going to put me in a slint. Go c&p 24th. I appreciate your advice

Carlie, My husband wants you to know that he can't type and I'm(the wife), doing this for him. First, he had his c&p yesterday at Lex. VA believe it or not it took almost 2 hrs. Think he got a good exam. She agreed that his PN in left foot and toes was really bad. He goes March 4 for a splint for left foot. Some of the guys out there that have PN tell me just how bad this is going to get? He won't say but at times he gets that deer in the headlights look. I mailed his new info (attached with) a 21-4138. I was reading your input with vync and wondered if I made a mistake by not trying to get it dated stamped? I'm new at this and by damn I am going to help him get his comp. Do I need send another 21-4138 with all his info on it? Got the acknowledgement of new info Feb 11, 2010. Do I need to resend? At this point we have not had any problems with lost records or having to wait on a c&p exam. Dr. says she will send asap. Explain about the nod. He has until April 24. 2009 with his initial claim, we sent new medical info in Oct, 2009, so are we still basically on the same claim? Advise and God Bless y'll

Your from Kentucky and have a loving wife that types for you :) . Stay strong and believe. Therefore you cannot be dumb B) .

I know, I'm from Harlan County and have a loving wife also, could not have made it without her love and devotion.
