Berta
I see he was a retiree. But he never elected or paid into SBP ? (Survivor Benefit Program) "We thought about getting a lawyer but evidently there are none in our state" If the formal Notice of Disagreement was filed on or after June 20, 2007 you can get a lawyer. They don't have to reside in the same state that you do.They do have to be fully accredited with the VA to represent VA claimants. There are many lawyers who represent veterans and widows listed at the National Veterans Organization of Veteran Advocates web site. http://www.vetadvocates.com/index.html Lawyers names pop up on BVA decisions. Many here have found lawyers. I don't think you would need a lawyer for the pension claim-they have not denied that claim and it is still pending- from what I see here. The direct Service connected death claim could be continued after they award a pension, and that would be good to have a lawyer handle. Did he get any consistent medical care from the VA itself? If so did the vet rep look into a Section 1151 potential? Edited June 26, 2010 by Tbird Added Link
