Getting Chapter 35 Retro

Question

My daughter started school before I was awarded 100% P&T, but my effective date precedes her enrolling in school. We filled out all the paperwork to get her schooling paid for, and just received her paperwork in the mail. According to the form they want her to send back they have decided to just pay her for the last month of her schooling, and not the fifteen months she went to school.

There is a place to change "Date of Change In Hours" and "Number of Hours After Change", which I ASSUME we can change her date to an earlier effective date, but we have no idea of what hours to put in. I have tried to call the VA office, and have received a "We're sorry but all of our line are busy" message for over an hour.

Has anyone here been able to apply for retro Chapter 35 payments?

Appeal the decision and have her request that VA use the effective date of your claim. They can fix it.

Remember that the VA does not treat Chapter 35 as your benefits but hers.

Thanks Pete53, I know the benefits are hers. She is soooo angry right now, and I'm just telling her that is is normal for the VA to screw things up in any way they can. But at least it's only been a couple of months since she applied, so it is moving quicker than I thought it would. I will try calling and calling some more to get an answer from them on what she is supposed to do.

I don't know anything about retro ch 35 but my kids will be looking into it after my effective date is corrected.

My corrected effective date will precede the dates that they started college.

One is a school teacher and one is almost an RN.

They had no reason to wait to start their higher education because I was rated at 20 percent at that time.

The third hit it right and she collected all through her college.

Now she's a banking systems annalist.

My corrected effective date will be a correction of an administrative error.

The corrected effective date is the last error that I have left to bitch about.

My kids are smart enough to have kept all of their education records.

The VA owes them a chunk.

You need to have your daughter call. They will not discuss her claim with you as it is a benfit in her own right. Just a heads up. Chapter 35 is her claim.

Bonzai - she has a choice of the date of notification of award, your effective date or any date in between. You'd better explain to your daughter that life is full of disappointments and the VA is the first of many. She will win but it takes time. Also, as SLEDGE stated, it's her claim and the VA won't/shouldn't discuss it, w/you, unless she's authorized it, w/a release.
