Dependents Pay

Question

My husband was just recently granted 60% Disability. Along with the original claim submitted over a year ago, the Dependents Form 21-686c was also submitted, along with the pertinent docs. If the VA had this info for over a year, why would they award the 60% WITHOUT dependents? When I questioned them about this, they told me that I had to resubmit the 21-686c, and that it would be treated as if it were a new claim, and dealt with in the order it was received.

I think the answer is that the VA will look for any way to shortchange a vet. Am I off the mark here?

They do dumb stuff like that all the time. Make copies and submit them back and be sure and point out it is a copy of info previously submitted.

Yes, you are a bit off the mark.

This is my understanding.

You submitted the original claim and included the 21-686c (and docs) back however long ago.

The claimant is not even eligible for any dependent comp UNTIL 30% (or higher) SC is granted.

Now the original claim has been granted and SC compensation with an evaluation percentage

of 60 % has been awarded.

Many things in regards to dependents may have changed, while awaiting this award.

It's a PITA - but if nothing has changed - just resubmit it all.

On my initial claim with the VA they paid me right out of the gate with dependents. I don't understand why they would not. If the Veteran included copies of the marriage cert's and the birth cert's, at least they could friggin do is call when they are ready to award and ask if the status od the dependents is the same, instead of making the Veteran file another claim, resubmitting the same information, and making the backlog bigger, and bigger, and longer and longer, while the Veteran has to wait for compensation pay they should not have to wait for.

But I guess it is easier to make the process even more difficult and find ways to jam up their claims backlog.

They're not trying to short change you. Eventually they will pay you for dependants and it will include a retro check for all the back pay to the date you were granted 60%. I don't know why they treat it as a seperate claim and make you wait. I've been through this myself. My advice is if either you or your spouse had any divorces before you two were married you need to send VA proof of the divorces being granted. That particular situation held up my claim for dependants for several months.(of course, that was my husband's fault; not mine!):smile:

YOU ARE RIGHT ON THE MONEY. jUST SEEN IN THE PAPER WORK, THE DID ME THE SAME WAY, because i was only 10% at first for years. When I got award sixty percent i had to resubmit my dependants paper work and a copy of my divorce and marriage license, and dependants bith certificate. It only took 30 days or less, because they still had my folder out. the quicker you send the paper work the quicker you get your money.

P.S. YOU ONLY HAVE A YEAR FOR THE RETRO, SO GO AND SEND IT IN.

The va did this to me when I went from a 30% rating to 40% then 60% then 80% well you get the picture...

The va needs current information, so a request prior to an award is not considered current.. how do they know if you still have kids at home or are married or divorced... any thing can happen in a year...

just resubmit, you won't lose any compensation ......
