Depression Claim Denied

Question

Im fight a claim for depression and was denined.Im at 50% right now. I have cronic pain,degenerating joint desease, authritus and both knees done, TKR total knee. I am taking antidepressants and seeing a psyc Dr. I have been suicidal at times. Any help would be appreciated. Congrats on ur rating.

You should be doing the depression as a secondary to the pain you have. that is the best way to win.

+2 this. The depression being tied to chronic pain is overwhelmingly documented. Is this an initial claim for depression, or an increase to depression specifically? If it is an initial claim you have to have your psych tie your pain to your depression, vs. any other things you have going on in your life.

In the wider world of psychiatry and pain management there is just no debate about chronic pain and depression. Only in the minds of cheap VA raters. They prescribe anti-depressants if you have chronic pain. Your doctor must say that your depression is secondary to your service connected disabilites. Maybe you could post a cleaned-up version of your decision.
