Got A Question On how I can Get the VA to move Quicker on this claim.

This is what I've done so far. I filed a claim in 1993. It was Denied in 1997 after the NC VA could not locate my medical files from time served in South West Asia. I continued Trying to Locate this missing Records at least once a year. Now after all this time I have received these Records that Clearly state the Accident, day and time - 4 times in the files. I was seen 4 different times for the same thing. I have Reopened the Claim sent these files to my Regional VA Office in Buffalo NY the 1st week of March. Followed by many other statements from Docters and Employers telling the on Going problems I have had. They have received all this and still have not made any move on doing the right thing? The Original Claim was Denied Because of lack of evidence. No medical records from time in service to prove that it was a service connection Injury. This is why it was denied. Would not the missing medical records be all they would need to seal the deal? How can I get them to move on this? I am no lawyer but it sure looks simple.What can I do to get them to move on this? Help!!

Got a Question I,m told with my two screwed up shoulders and bad Hips, hearing and sore joints and a bad attitude that I am considered unemployable. So this means I am eligable for I.U. . I have 5 kids ...a wife ...what kind of payment am I looking at for 100% unemployable . Just wondering? Is there a rate chart someplace here on hadit?

Rick-here is the rate chart link from the VA for IU (100% rate) and the other rates-

It says Dec 2005 rates and these will go up next month and be reflected in the Jan comp checks.

Any veteran who is not employed and who believes that their SC disabilities make them unable to work should apply for TDIU.

It will take clear medical evidence that they cannot work due to SC disability.

Many veterans get SSA award on SC disability before the VA award comes.

But the VA only considers SSA awards that reflect the extent of the service connected disabilties.

If a vet gets SSA for NSC diabetes-and has claim for TDIU due to PTSD-the SSA award doesn't help the VA claim.

If a vet gets SSA for PTSD however, that would help the VA claim for SC PTSD,with proof of inservice stressors.

I knew a vet here in the boonies who lived like a "trip wire " vet.

He got SSI for PTSD.

He never succeed in getting VA comp for PTSD.

His stressors were before and after service and none of his claimed inservice stressors could be proven.

I know because I worked on his claim for a long time.

The VA agreed he had PTSD but found no basis for service connection.

Then again- SSA gave my husband SSA award for PTSD due to his service stressors and VA med recs.

(early 1993 SSA award with a retro date of 1991)

Even with this evidence ,it took the VA 4 more years to award him 100% SC PTSD.(1997-but he was already dead)

He never saw a SSA doctor as the med recs from VA totally supported the SSA findings.

Figure that ???

But usually 99% of the time SSA records can be very probative evidence if they(SSA) award for the same claimed SC disability.

I am not sure what type of military records that you are trying to locate. Mine is a long story. I was discharged in 1964 and located my psychiatric records and a letter from my Commander from the St. Louis Archives.

When I filed in 1978 - the Va. did not request these records, as all psychiatric records are stored separately.

When I filed again in 2002 same thing happend.

Awared Pension in 2003, but denied due to excessive income.

I secured the long lost records in 2004 and presented copies with seal to the Va.

Claims file is re-opened to original filing date.

This year when I contacted the St. Louis Archives again for records, they called me and I told them what I was specifically looking for and the located my request for transfer out of this duty station.

You may contact the St. Louis Archives and tell them exactly what you are looking for. They will search until they can't search anymore.

They have been of tremendous help to me.
