If there is a diagnosis of Menier's in the SMRs and there is a current diagnosis, SC should be no problem. Hearing imparment is the crucial piece in getting to a compensable evaluation, even under the alternative method because, as we all know, one has to be pretty deaf to get paid for the disability.

6204 Peripheral vestibular disorders:

Dizziness and occasional staggering 30

Occasional dizziness 10

Note: Objective findings supporting the diagnosis

of vestibular disequilibrium are required before

a compensable evaluation can be assigned under

this code. Hearing impairment or suppuration

shall be separately rated and combined.

6205 Meniere's syndrome (endolymphatic hydrops):

Hearing impairment with attacks of vertigo and 100

cerebellar gait occurring more than once weekly,

with or without tinnitus

Hearing impairment with attacks of vertigo and 60

cerebellar gait occurring from one to four times

a month, with or without tinnitus

Hearing impairment with vertigo less than once a 30

month, with or without tinnitus

Note: Evaluate Meniere's syndrome either under

these criteria or by separately evaluating

vertigo (as a peripheral vestibular disorder),

hearing impairment, and tinnitus, whichever

method results in a higher overall evaluation.

But do not combine an evaluation for hearing

impairment, tinnitus, or vertigo with an

evaluation under diagnostic code 6205.

I have a case I'm working for Menier's right now that the VA denied because the vet has tinnius but no hearing loss. We are getting lays statements that he has vertigo attacks and gait problems pretty much at random.

Hi,

My brother-in-law was in the Navy and was in the Gulf War. He got out I think in 1995. When he was discharged, he was told he had Menere's Disease and think he also had vertigo with it. Anyway, he can't seem to hold a job at all and might make a couple 1000 dollars a yr. if that, is there anything he can do at this point or is it too late?

He never filed a VA claim and I don't know why.

Isn't there a time limit, like within 1 yr after getting out, that you have to file a claim?

He's been out for years, so that's why I thought it was too late, but I certainly don't know this stuff.

A claim for SC can be filed at any time, however, the longer the time between discharge and claim, the harder it is to show nexis.

Isn't there a time limit, like within 1 yr after getting out, that you have to file a claim?

He's been out for years, so that's why I thought it was too late, but I certainly don't know this stuff.

I have neen diagnosed with both meniere's and benign posistional vertigo, the va combined my vertigo with tinnitus and gave me a 10% rating.There was no reason for them to do it, they just did. My SMR is full of episodes of vertigo that lasted 10 days or longer and required bedrest, but yet the VA gave me 10% for tinnitus with vertigo, I am fighting it. Just a warning of what happened to me. The C&P Doctor didnt even ask about it when they did the C&P
