Va's "new Deal"...wait Until Sol Is Up To Inform You.

The VA has a "new deal". Wait until the Statue of limitations is over before informing Vets they were infected. That way, it costs the VA zero. Remember those Vets that got exposed to Hep by the VA's colonoscopies with dirty equipment? Suprise, Suprise..the VA is fighting these Vets tooth and nail and at least one Vet lost

Hello Berta and Bronco,

Thank you both for your thoughts on this.

I probably should have added that the damages are what I was referring to for the state tort limits. And yes the 1151 is for the Medical damage that may link service connection. I am under the impression from what I have read and listened to Berta that the Tort ,,,,FTCA should be given a chance to succeed or settled to be able to proceed further with the 1151. I also have read that the 1151 does not mean an instant award if the the FTCA is settled rather than a Federal decision and the Claimant wins his case outright. The win , I feel gives the Section 1151 more weight to fire at the VA for a better chance of winning it. And I agree that the Medical win is not to be confused with the Compensatory damages as in FTCA.

I cannot find a FTCA that is awarded outside of the state where the case or damages were committed. Berta please correct me on this if I am wrong. I believe you won your FTCA in New York but it had to be tried or litigated there which is were this took place.
