Claims Working Process

Once in a while you get a letter from your regional office stating the following Your claim is awaiting review of all the development to determine if additional actions are needed. Once the claim is determined to be ready for a decision, it will be delivered to our rating team for a decision. The development phase takes approximately twelve to fourteen months. The rating decision phase takes approximately two to three months and the notification phase takes approximately sixty days. A notification letter with a copy of the rating decision will be sent to you once it is completed.

If you have one of the following: foreclosure notice, eviction notice and or a utility shut off notice. We can expedite your claim due to financial hardship.

We are working on claims in the order we received them oldest to newest. Thank you for your service and patience. Now let me show you how the bold statement is false claimant no 1 files their claim Sept 2010 Claimant #2 files in Nov 2010 claimant # 2 waits 600+ days!! bingo claim gets processed while claimant #1 is pending 700+ days. If my math serves me correct claimant no#1 should have been processed first?? Why does the VA be untruthful with the veteran i rather you tell me to my face "Hurry up and wait" lol!!!

You would think they would honor the hardship but you never know seeing as they are so backed up

Brother, a very dear friend of mine is on 02 and in a wheelchair.

His house took a direct hit from an F5 tornado and he filed a hardship.

That was 18 months ago.

Don't put too much faith into hardship.

They have consistently proven they really dont care.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

Ya know, the VA's claim system at the initial onset is supposed to be non-adversarial. It claims to be purely ex parte, meaning that they weigh the evidence based upon the evidence produced by the Veteran and medical evidence obtained during the processes. That's one reason legal counsel is not allowed during the initial claims process. However, more and more often, the VA's delays and denials prove that it is truly an adversarial system where winner takes all, or a settlement is reached.

I hope your friend on O2 finally gets fair justice and gets the help he deserves.

You can say that again Mark.

If a system is based on Law, It seems kind of crazy that attorneys cant touch it until a denial is made. That takes the legal precedent out of the equasion and the veteran has no way to contradict the VA decisions before having to go to the appeal stage.

That is like tying your hands behing your back and punching you repeatedly in the face.

One good arguement to make is the fact that these Employees at the RO are just that. GS employees. They do not posess license to practive medicine. They damn sure dont posess a license to prtactice law.

So then my claim just went back to the gathering of information phase from pending decision approval and it stated that a development letter is sent does this means what? it also stated that you claim needs additional review.
