Service Connection After Death Of Veteran & Dic For Spouse

Hello Everyone,

My question is this. Can a surviving spouse of a non-service connected, decease Veteran receive DIC? If the Veteran could have been service connected for AO Exposure in Korea during the recognized years. The Veteran die of an unexpected heart attack. He had Hypertension and Diabetes too but, wasn't aware he could qualify before death. If the answer is yes. How would I prove he served in a particular unit eligible for SC. Be it assigned or attached to these units recognized by VA & DOD. The DD 214 states a unit but, this unit was scattered all over Korea? We don't know where he served in Korea. The spouse has already filed but, was denied in about two months. Any advice would be greatly appreciated.

Yes she could but she'll need to prove the exposure, where he was, prove his heart disease, diabetes, etc. It will take a while to gather the evidence but it can be done. Records can be found at the NPRC in St Louis, MO and at the National Archives, College Park, MD.

Ischemic Heart disease is an AO presumptive disability...DMII too.

What Unit was in and when was he in it?

Does the widow have his complete SMRs and 201 personnel file?

Also did he ever mention the names of any buddies in Korea he had? Surviving spouses can seek 'buddy statements' just as vets can.

His unit sure must have a web site of their own and might have a reunion roster there or other info that can help her.

With the spouses permission could you cover her name,address and C file number and scan and attach the decision here?

We need to see the VA's Reasons and Bases for denial and the Evidence list in the denial.

I am not sure if there is a more updated unit list....if so it will be in the new VBM coming out any day now.....

I will contact a lawyer I know at NVLSP and ask...

forgot....the Korean War Project site has some excellent war maps of of Korea. I couldnt past my Korea war map here....something there, such a name of a place on a map , might ring a bell with the widow.

Also I interviewed one of the Barkers about their Korean War Project.... cant remember if it was our SVR radio show or another station.

Hello: My name Larry

I am trying to get help for my aunt. We filed her DIC claim on December 15, 2010.

On March 31, 2011 the VA denied her claim.

We filed a NOD on 19 April 2011.

In Feb 2014 we were told here claim was on the DRO's desk. we have or can not get any information to date.

Any information you can give will help.

Larry, It is a good idea to post these questions as a new topic in this forum....that way more can read and help.

Can you scan and attach the denial to a post here" (Cover C file name address prior to scanning it.)

We need to read their Reason and Bases for the denial and see the evidence list.

That way we can understand why they denied and what she can do to overcome the denial.
