Revoking Poa While Claim Is At Bva

Question

I appointed a VSO at the time of my hearing. The hearing was awful. I felt comfortable with the judge. But the VSO treated me like an idiot. I know I should have fired the VSO immediately. But I did not.

We were granted 3 months, until December 3, to provide additional evidence in support of my claim. The VSO had told me to obtain copies of my husband's military personnel files. I have now done that. I also hoped he might actually read my claim in the interim.

I called the VSO today to inform him I had received the files he had requested I obtain and to see where we stood on my case. He told me that he had submitted everything to the judge already and that it was DONE. He said he had already done what he needed to do on my claim.

I asked him what he submitted, and he said he wouldn't know that without looking at the file -- and he couldn't "jump around like that."

I asked him to send me a copy of what he sent to the judge and he told me he is NOT REQUIRED to send me anything. He was very curt and told me if I want copies of what he submitted I have to contact my Regional Office and get them from them.

I want to revoke his POA IMMEDIATELY -- and so I will fax a revocation to the BVA. Should I be specific as to why? Or just state I want to revoke his POA?

I hope he didn't hurt my case really bad by arguing against my claim. I don't know why he refuses to send me a copy of what he submitted. I don't know if that is because he submitted something he knows I wouldn't like, or if he actually has no idea what is going on with my claim, didn't want to bother to look before he returned my call -- and just told me he submitted everything without even checking - and felt like he was put on the spot when I asked for a copy.

OMG! I was shaking when I got off the phone!!!

You are paying nothing for the services of a VSO, so "nothing" is often what you get. VFW and DAV actively screwed up my claims in the past. The DAV was arrogant, worthless and never returned calls. The SOB would hide when I went to see him. I learned how to file claims here at Hadit and using good IME's for evidence. I am sure there are great and dedicated VSO's out there. I met one about 40 years ago who helped me with my discharge review. He was an old man who worked for the Red Cross for Pete's sake. He had them crying at the hearing and my general discharge was changed to straight honorable post haste. The rest of them never looked at my C-File to see how I had been screwed in my original rating. They just forwarded the corrupted paperwork on the the next dork who signed off on a denial. No one ever sat me down and said "This is what you need to win an increase". They did tell me "Don't ask for more or you will lose your 10%, you poor bastard".

I assumed your question on who appoints superior court judges was related to the fact that a superior court judge was the founder of the DAV. You then post posted a post on the process/proceedure on appointing Supreme Court Justices. Apples and Oranges. A superior court judge is not a Supreme Court Justice. Not sure of the intent on your original question, or how/why the Supreme Court appointment and confrimation is now being brought up?

This thread is about our fellow member 'Free_Sprit_etc.' and her dilemma with the BVA and VSO.
JMHO... This thread appears to be sliding off topic , down a rabbit trail that deserves it's own Topic Heading.

If you fire your VSO hire a lawyer. I am not too happy with my lawyer right now, but at least he returns phone calls. He has a lot to lose if he *&&^%$ up my claim. He signed on for 20% of my retro back to 1971 if we win, so he is motivated. Sometimes I want to wring his neck and sometimes I want to shake his hand.

Veterans were not allowed to retain attorneys to represent them until 2007, after over a 140-year prohibition that prevented them from hiring lawyers. Before then, we had to rely on a vso or go it alone. No matter how clear and factually proven your claim is, I strongly suggest you don't try to go it alone. If you don't feel comfortable with a VSO, then find a lawyer to help you.
