cragwex
I received my 100 percent rating letter which states I am rated at 100 percent back to my exam which was done in April 2014. E-benefits states that I am due for reduction in Jul of 2018. I know this is standard but none of my service connected disabilities will ever get better. I am filing a FDC claim for bilateral hip arthritis and IBS. Will that make any difference?
marine0816
What are your disabilities? 2004-06= 0% 2006-13= 10% 2013-14= 30% 2014-17= 90% 2017= 100% 2018 = 100% PT (still at BVA)
USMC_HVEQ
Congrats on the 100%, but regardless of your beliefs if they will improve or not, the VA is often hopeful so they tend to shy away from giving a P&T status unless it has been rated static by the VA for 5 yrs, that is just my opinion. FormerMember
VA will schedule a new C&P in two years, usually following a 100% schedular rating. You can attain P&T sooner by having your PCP write a letter stating you're not going to be ready for the Boston Marathon any time soon and may (or will) be even more debilitated by 2018. I have used it numerous times for my guys/gals. It helps to pepper the letter with the word "chronic" and "irreversible". The 5 year rule is only to prevent clawbacks of a rating prematurely. You become substantially protected after five years against it but are only immune after 20 years. After five years, it will require at least two C&Ps to overturn a 100% schedular-or any rating for that matter. NavyWife
Navy04
Congrats on the 100% bud, and I too am 100% Temporary even though I have a lot of health issues. I was just awarded the 100% last year, yet just had multiple Reviews 2 weeks ago. That whole process is scary as hell. I just went in there and was honest, and it looks like a few of the prior rated conditions may actually be increased. Just continue to seek treatment and go from there. I have a few conditions that will never be cured or get better, like Crohn's Disease, yet I am Temp.
