Question

I RECENTLY SUBMITTED A CLAIM FOR SLEEP APNEA .......I COMPLAINED SEVERAL TIMES ABOUT MY SLEEPING ISSUES AND

BEING TIRED AND MY WIFE COMPLAINING ABOUT MY SNORING ..I HAD A SLEEP STUDY DONE WHILE ON ACTIVE DUTY 2012

AND THE RESULTS CAME BACK THAT I DIDN'T HAVE SLEEP APNEA BUT I DID HAVE A SLEEPING DISORDER...I WAS GIVEN THE

SNORING MOUTHPIECE , LUNESTA , AND....METHACARBAMOL TO HELP WITH THE SLEEP DISORDER BUT IT ONLY WORKED

FOR A COUPLE OF MONTHS I HAD THE MOUTHPIECE ADJUSTED AND STILL WAS TIRED DURING THE DAY AND WIFE STILL

COMPLAINED ABOUT ME SNORING ......AFTER I GOT OUT I KEPT TALKING TO MY DOC ABOUT MY SLEEP ISSUES AND ASKED

FOR ANOTHER SLEEP STUDY AND THE RESULTS CAME BACK SEVERE SLEEP APNEA ....I SUBMITTED A FULLY DEVELOPED

CLAIM WITH STATEMENTS FROM MY WIFE AND MY A BATTLE BUDDY FROM DEPLOYMENT THAT ALSO COMPLAINED ABOUT

MY SNORING...AND THE RESULTS FROM BOTH SLEEP STUDIES

I KNOW A LOT OF CASES GET DENIED FOR SERVICE CONNECTION BUT ITS WORTH A TRY I THINK ....JUST ASKING FOR

You should get an IMO from a sleep disorder specialist stating they have reviewed your SMRs and your private sleep study and in their opinion, your sleep apnea was present during your military service. Since you had symptoms of sleep apnea during your recent military service and your SMRs include a record of those symptoms, I believe an IMO from a specialist along with the recent sleep study will overcome any different opinion from a C & P examiner. JMO

Wow that is a strong point that was made by GP. Listen here it's not the diagnosis you should be after, it is evidence of the symptoms while in service. You got that and that will be KICK YOUR TEETH IN MAMA of evidence. JMO, consider filing the claim with the service med records and let the VA monkey around with it. Let them deny or connect it at 0% or less. While your waiting for that get an IMO/IME and have the doc review your medical records, and your current records with symptoms and, JMO, you should be in good shape.

I think if my SMR's would have referenced my symptoms, signs and the sleep studies I got within the year of coming back from the desert I would have had a better shot at getting connected for OSA.
